Illinois General Assembly - Bill Status for HB 6848

Amends the Local Planning Technical Assistance Act. Requires the Department of Commerce and Economic Opportunity, through the Opportunity Returns Economic Development Regions established by the Governor, to designate certain units of local government and areas of the State as regional priority funding areas in which State infrastructure resources should be focused. Requires the Department to give preference to certain units of local government and areas of the State. Authorizes the Department to make grants to units of local government designated as, or within areas designated as, regional priority funding areas for the expansion or improvement of public infrastructure. Authorizes a unit of local government designated as, or within an area designated as, a regional priority funding area to impose reasonable impact fees on private developers for public infrastructure outlays and to share in infrastructure maintenance costs. Authorizes the Department to promulgate rules necessary to implement and administer these provisions. Amends the Governor's Office of Management and Budget Act. Provides that if a Department or Agency of the State has received negative interagency review comments or findings, then the Office must review those comments and findings before funding may be authorized for the proposed project or activity. Amends the Regional Planning Commission Act and the Counties Code. Authorizes a county board to establish an Intergovernmental Cooperation Council to develop and recommend various plans for the coordination of land use, transportation, and infrastructure. Authorizes the Council to (i) serve as a county's regional planning commission, (ii) recommend future municipal boundaries, and (iii) recommend an intergovernmental review process for land use and a voluntary, non-binding resolution process for intergovernmental disputes over land use. Provides that a unit of local government in a county that has established a Council and has met other qualifications shall be given priority for State grants and State programs.

Includes ordinances or resolutions that promote mixed-use development among those that are a factor in giving preference to a unit of local government in designation regional priority funding areas. Deletes provisions authorizing a unit of local government within a regional priority funding area to impose reasonable impact fees on private developers for public infrastructure outlays and to share in the maintenance costs for that infrastructure. Provides that the number of county board members appointed to an Intergovernmental Cooperation Council shall not exceed the number of mayors appointed to the Council. Provides that a plan prepared by the Council concerning projected future municipal boundaries must indicate that a municipality is better able and prepared than other municipalities to efficiently and effectively provide public infrastructure (now, urban services).

Further amends the Local Planning Technical Assistance Act. Provides that the designated regional priority funding areas in which State infrastructure resources should be focused must be certified by the Department of Commerce and Economic Opportunity to have completed and adopted a comprehensive plan containing certain required elements.

Deletes everything. Amends the Local Planning Technical Assistance Act. Creates a Local Planning Task Force consisting of representatives of various State departments and agencies in order to identify existing State planning programs and State resources for local planning grants, develop a system of preference for grants to certain communities, and recommend that the State departments or agencies responsible for the identified programs adopt rules requiring those programs to comply with certain provisions of the Local Planning Technical Assistance Act. Sets forth procedures for operations of the task force. Requires the task force to report to the General Assembly by December 31, 2004. Effective immediately.

Amends the Local Planning Technical Assistance Act. Authorizes the Department of Commerce and Economic Opportunity to designate certain areas as priority funding areas and to make grants to units of local government designated as or within areas designated as priority funding areas for the expansion or improvement of public infrastructure. Creates a Priority Funding Advisory Committee to develop detailed criteria for use by the Department in making funding decisions for priority funding areas and for Intergovernmental Cooperation Councils. Amends the Governor's Office of Management and Budget Act. Requires the Governor's Office of Management and Budget to review negative comments or findings that result from interagency review before funding may be authorized for a proposed project or activity. Amends the Regional Planning Commission Act. Deletes a provision requiring governing bodies of certain units of local government to obtain authorization from the Department of Commerce and Economic Affairs in order to cooperate with the governing bodies of other units of local government in the creation of a joint planning commission. Provides that a county board may designate an Intergovernmental Cooperation Council as the joint planning commission. Amends the Counties Code to authorize county boards to establish by resolution an Intergovernmental Cooperation Council to develop coordinated and intergovernmental plans and to direct implementation and revision of plans and procedures for intergovernmental cooperation. Provides for the membership, powers, and duties, of the Council. Effective January 1, 2006, except for the provisions of the bill concerning the Local Planning Task Force, which are effective immediately.
