Illinois General Assembly - Bill Status for SB 2907

Amends the Public Utilities Act and the Consumer Fraud and Deceptive Business Practices Act. Provides that, notwithstanding any other provision of law, the Illinois Commerce Commission and its staff shall work cooperatively with law enforcement authorities, including the Attorney General and State's Attorneys, in their enforcement of consumer protection laws, including the Consumer Fraud and Deceptive Business Practices Act, provide any materials or documents requested by the Attorney General or a State's Attorney pertaining to the enforcement of consumer protection laws, and, upon written request, forward any complaints regarding alleged violations of any consumer protection law to the Attorney General and the appropriate State's Attorney. Provides that all remedies and authority granted to the Attorney General or the State's Attorneys by the Consumer Fraud and Deceptive Business Practices Act shall be available even though the matter is also subject to the Public Utilities Act. Provides that the Public Utilities Act and the Illinois Commerce Commission's rules do not preclude any action that may be available by law, and that the remedies for violations of the Public Utilities Act and its rules are not intended to replace other remedies that may be imposed by the courts for violation of other consumer protection laws and are in addition to, and not in substitution for, other available remedies.

Deletes everything and re-inserts similar provisions with these changes: in provisions requiring the Commission and its staff to provide any materials or documents requested by the Attorney General or a State's Attorney pertaining to the enforcement of consumer protection laws, limits the scope to materials or documents already in the Commission's possession and provides that materials or documents that are proprietary shall not be made public unless the designation as proprietary has been removed by a court or legal body of competent jurisdiction, or the agreement of the parties; provides that, subject to provisions of the Consumer Fraud and Deceptive Business Practices Act exempting from the Act actions or transactions specifically authorized by laws administered by any regulatory body or officer acting under statutory authority of this State or the United States, the Attorney General and State's Attorneys have available all remedies and authority granted to them by that Act and remedies for violations of the Public Utilities Act and its rules are not intended to replace other remedies that may be imposed for violations of the Consumer Fraud and Deceptive Business Practices Act, nor is either Act intended to remove any statutory defenses.
