 1        AN ACT concerning higher education.

 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:

 4        Section 5.  The University of Illinois Act is amended  by
 5    adding Section 7e-5 as follows:

 6        (110 ILCS 305/7e-5 new)
 7        Sec. 7e-5.  In-state tuition charge.
 8        (a)  Notwithstanding  any  other  provision of law to the
 9    contrary, for tuition purposes, the Board of  Trustees  shall
10    deem an individual an Illinois resident, until the individual
11    establishes  a residence outside of this State, if all of the
12    following conditions are met:
13             (1)  The individual resided with his or  her  parent
14        or  guardian  while  attending  a  public or private high
15        school in this State.
16             (2)  The  individual  graduated  from  a  public  or
17        private high school or received the equivalent of a  high
18        school diploma in this State.
19             (3)  The  individual  attended  school in this State
20        for at least 3  years  as  of  the  date  the  individual
21        graduated  from high school or received the equivalent of
22        a high school diploma.
23             (4)  The individual registers as an entering student
24        in  the  University  not  earlier  than  the  2003   fall
25        semester.
26             (5)  In  the  case  of  an  individual  who is not a
27        citizen or a permanent resident of the United States, the
28        individual provides  the  University  with  an  affidavit
29        stating  that  the individual will file an application to
30        become a permanent resident of the United States  at  the
31        earliest opportunity the individual is eligible to do so.

 1        (b)  This  Section  applies only to tuition for a term or
 2    semester that begins on or after the effective date  of  this
 3    amendatory Act of the 93rd General Assembly. Any revenue lost
 4    by  the  University  in  implementing  this  Section shall be
 5    absorbed by the University Income Fund.

 6        Section 10.  The Southern Illinois University  Management
 7    Act is amended by adding Section 8d-5 as follows:

 8        (110 ILCS 520/8d-5 new)
 9        Sec. 8d-5.  In-state tuition charge.
10        (a)  Notwithstanding  any  other  provision of law to the
11    contrary, for tuition  purposes,  the  Board  shall  deem  an
12    individual   an   Illinois  resident,  until  the  individual
13    establishes a residence outside of this State, if all of  the
14    following conditions are met:
15             (1)  The  individual  resided with his or her parent
16        or guardian while attending  a  public  or  private  high
17        school in this State.
18             (2)  The  individual  graduated  from  a  public  or
19        private  high school or received the equivalent of a high
20        school diploma in this State.
21             (3)  The individual attended school  in  this  State
22        for  at  least  3  years  as  of  the date the individual
23        graduated from high school or received the equivalent  of
24        a high school diploma.
25             (4)  The individual registers as an entering student
26        in   the  University  not  earlier  than  the  2003  fall
27        semester.
28             (5)  In the case of  an  individual  who  is  not  a
29        citizen or a permanent resident of the United States, the
30        individual  provides  the  University  with  an affidavit
31        stating that the individual will file an  application  to
32        become  a  permanent resident of the United States at the

 1        earliest opportunity the individual is eligible to do so.
 2        (b)  This Section applies only to tuition for a  term  or
 3    semester  that  begins on or after the effective date of this
 4    amendatory Act of the 93rd General Assembly. Any revenue lost
 5    by the University  in  implementing  this  Section  shall  be
 6    absorbed by the University Income Fund.

 7        Section  15.  The Chicago State University Law is amended
 8    by adding Section 5-88 as follows:

 9        (110 ILCS 660/5-88 new)
10        Sec. 5-88.  In-state tuition charge.
11        (a)  Notwithstanding any other provision of  law  to  the
12    contrary,  for  tuition  purposes,  the  Board  shall deem an
13    individual  an  Illinois  resident,  until   the   individual
14    establishes  a residence outside of this State, if all of the
15    following conditions are met:
16             (1)  The individual resided with his or  her  parent
17        or  guardian  while  attending  a  public or private high
18        school in this State.
19             (2)  The  individual  graduated  from  a  public  or
20        private high school or received the equivalent of a  high
21        school diploma in this State.
22             (3)  The  individual  attended  school in this State
23        for at least 3  years  as  of  the  date  the  individual
24        graduated  from high school or received the equivalent of
25        a high school diploma.
26             (4)  The individual registers as an entering student
27        in  the  University  not  earlier  than  the  2003   fall
28        semester.
29             (5)  In  the  case  of  an  individual  who is not a

 8        Section  20.  The  Eastern  Illinois  University  Law  is
 9    amended by adding Section 10-88 as follows:

11        Sec. 10-88.  In-state tuition charge.
12        (a)  Notwithstanding any other provision of  law  to  the
13    contrary,  for  tuition  purposes,  the  Board  shall deem an
14    individual  an  Illinois  resident,  until   the   individual
15    establishes  a residence outside of this State, if all of the
16    following conditions are met:
17             (1)  The individual resided with his or  her  parent
18        or  guardian  while  attending  a  public or private high
19        school in this State.
20             (2)  The  individual  graduated  from  a  public  or
21        private high school or received the equivalent of a  high
22        school diploma in this State.
23             (3)  The  individual  attended  school in this State
24        for at least 3  years  as  of  the  date  the  individual
25        graduated  from high school or received the equivalent of
26        a high school diploma.

12        Sec. 15-88.  In-state tuition charge.
13        (a)  Notwithstanding  any  other  provision of law to the
14    contrary, for tuition  purposes,  the  Board  shall  deem  an
15    individual   an   Illinois  resident,  until  the  individual
16    establishes a residence outside of this State, if all of  the
17    following conditions are met:
18             (1)  The  individual  resided with his or her parent
19        or guardian while attending  a  public  or  private  high
20        school in this State.
21             (2)  The  individual  graduated  from  a  public  or
22        private  high school or received the equivalent of a high
23        school diploma in this State.
24             (3)  The individual attended school  in  this  State
25        for  at  least  3  years  as  of  the date the individual
26        graduated from high school or received the equivalent  of
27        a high school diploma.
28             (4)  The individual registers as an entering student
29        in   the  University  not  earlier  than  the  2003  fall
30        semester.
31             (5)  In the case of  an  individual  who  is  not  a

 9    absorbed by the University Income Fund.

10        Section 30.  The Illinois State University Law is amended
11    by adding Section 20-88 as follows:

12        (110 ILCS 675/20-88 new)
13        Sec. 20-88.  In-state tuition charge.
14        (a)  Notwithstanding  any  other  provision of law to the
15    contrary, for tuition  purposes,  the  Board  shall  deem  an
16    individual   an   Illinois  resident,  until  the  individual
17    establishes a residence outside of this State, if all of  the
18    following conditions are met:
19             (1)  The  individual  resided with his or her parent
20        or guardian while attending  a  public  or  private  high
21        school in this State.
22             (2)  The  individual  graduated  from  a  public  or
23        private  high school or received the equivalent of a high
24        school diploma in this State.
25             (3)  The individual attended school  in  this  State
26        for  at  least  3  years  as  of  the date the individual
27        graduated from high school or received the equivalent  of
28        a high school diploma.
29             (4)  The individual registers as an entering student
30        in   the  University  not  earlier  than  the  2003  fall
31        semester.
32             (5)  In the case of  an  individual  who  is  not  a

11        Section  35.  The Northeastern Illinois University Law is
12    amended by adding Section 25-88 as follows:

13        (110 ILCS 680/25-88 new)
14        Sec. 25-88.  In-state tuition charge.
15        (a)  Notwithstanding any other provision of  law  to  the
16    contrary,  for  tuition  purposes,  the  Board  shall deem an
17    individual  an  Illinois  resident,  until   the   individual
18    establishes  a residence outside of this State, if all of the
19    following conditions are met:
20             (1)  The individual resided with his or  her  parent
21        or  guardian  while  attending  a  public or private high
22        school in this State.
23             (2)  The  individual  graduated  from  a  public  or
24        private high school or received the equivalent of a  high
25        school diploma in this State.
26             (3)  The  individual  attended  school in this State
27        for at least 3  years  as  of  the  date  the  individual
28        graduated  from high school or received the equivalent of
29        a high school diploma.
30             (4)  The individual registers as an entering student
31        in  the  University  not  earlier  than  the  2003   fall
32        semester.

12        Section 40.  The  Northern  Illinois  University  Law  is
13    amended by adding Section 30-88 as follows:

14        (110 ILCS 685/30-88 new)
15        Sec. 30-88.  In-state tuition charge.
16        (a)  Notwithstanding  any  other  provision of law to the
17    contrary, for tuition  purposes,  the  Board  shall  deem  an
18    individual   an   Illinois  resident,  until  the  individual
19    establishes a residence outside of this State, if all of  the
20    following conditions are met:
21             (1)  The  individual  resided with his or her parent
22        or guardian while attending  a  public  or  private  high
23        school in this State.
24             (2)  The  individual  graduated  from  a  public  or
25        private  high school or received the equivalent of a high
26        school diploma in this State.
27             (3)  The individual attended school  in  this  State
28        for  at  least  3  years  as  of  the date the individual
29        graduated from high school or received the equivalent  of
30        a high school diploma.
31             (4)  The individual registers as an entering student

13        Section  45.  The  Western  Illinois  University  Law  is
14    amended by adding Section 35-88 as follows:

17        (a)  Notwithstanding  any  other  provision of law to the
18    contrary, for tuition  purposes,  the  Board  shall  deem  an
19    individual   an   Illinois  resident,  until  the  individual
20    establishes a residence outside of this State, if all of  the
21    following conditions are met:
22             (1)  The  individual  resided with his or her parent
23        or guardian while attending  a  public  or  private  high
24        school in this State.
25             (2)  The  individual  graduated  from  a  public  or
26        private  high school or received the equivalent of a high
27        school diploma in this State.
28             (3)  The individual attended school  in  this  State
29        for  at  least  3  years  as  of  the date the individual
30        graduated from high school or received the equivalent  of
31        a high school diploma.
32             (4)  The individual registers as an entering student

14        Section  50.  The Public Community College Act is amended
15    by adding Section 6-4a as follows:

16        (110 ILCS 805/6-4a new)
17        Sec. 6-4a. In-state tuition charge.
18        (a) Notwithstanding any other provision  of  law  to  the
19    contrary,  for  tuition  purposes,  a  board  shall  deem  an
20    individual   an   Illinois  resident,  until  the  individual
21    establishes a residence outside of this State, if all of  the
22    following conditions are met:
23             (1) The individual resided with his or her parent or
24        guardian  while attending a public or private high school
25        in this State.
26             (2)  The  individual  graduated  from  a  public  or
27        private high school or received the equivalent of a  high
28        school diploma in this State.
29             (3) The individual attended school in this State for
30        at  least 3 years as of the date the individual graduated
31        from high school or received the  equivalent  of  a  high
32        school diploma.

 1             (4)  The individual registers as an entering student
 2        in the community college not earlier than the  2003  fall
 3        semester.
 4             (5)  In  the  case  of  an  individual  who is not a

 6        individual  provides  the  community  college   with   an
 7        affidavit  stating  that  the  individual  will  file  an
 8        application  to become a permanent resident of the United
 9        States at the  earliest  opportunity  the  individual  is
10        eligible to do so.
11        (b)  This  Section  applies only to tuition for a term or
12    semester that begins on or after the effective date  of  this
13    amendatory Act of the 93rd General Assembly.

14        Section  99.  Effective date.  This Act takes effect upon
15    becoming law.
