 1        AN ACT in relation to highways.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section  5.  The  Illinois Adopt-A-Highway Act is amended
 5    by changing Sections 10 and 25 as follows:

 6        (605 ILCS 120/10)
 7        Sec. 10.  Definitions.  For purposes of this Act:
 8        "Group"  means  members  or   employees   of   civic   or
 9    not-for-profit   organizations,  and  commercial  or  private
10    enterprises,  who  have  requested  to  participate,  or  are
11    participating in, an Adopt-A-Highway program.
12        "Litter" means any unsightly or offensive matter that may
13    include,  but  is  not  limited  to,  disposable   packaging,
14    containers,  cans,  bottles,  paper,  ashes,  and  cigar  and
15    cigarette  butts.   Litter does not include hazardous, heavy,
16    large items, or carcasses.
17        "Group coordinator" means the individual  selected  by  a
18    group to serve as its liaison with a sponsoring jurisdiction.
19        "Group   president"  means  the  individual  who  is  the
20    recognized leader, president, or chairman for a group.
21        "Adopted section" means a length of municipal,  township,
22    county,  or  State  right-of-way identified by the sponsoring
23    jurisdiction as a safe, adoptable section of right-of-way for
24    adoption by a  group.    Sections  of  rights-of-way  may  be
25    determined inappropriate for adoption for safety reasons.  No
26    interstate highway shall be an adopted section.
27        "Director"  means  the  designee  or  designees  for  any
28    municipality,  township, or county who has responsibility for
29    the  administration  of  a   jurisdiction's   Adopt-A-Highway
30    programs.
31        "Sponsoring  jurisdiction"  means the Illinois Department

 1    of Transportation or any municipality,  township,  or  county
 2    that   establishes   Adopt-A-Highway   programs   within  its
 3    jurisdictional area.

 6        Sec.  25.  Responsibilities   of   the   group.    Groups
 7    participating in an Adopt-A-Highway program shall:
 8             (1)  be  required  to obey and abide by all laws and
 9        regulations relating to safety and any  other  terms  and
10        conditions as required by the sponsoring jurisdiction;
11             (2)  provide one adult supervisor for every 5 youths
12        when  persons  under  age  18  are  present on an adopted
13        section;
14             (3)  not allow a person under the age of 10 to be  a
15        member  of  the  group  who would be volunteering for the
16        purpose of litter collection along a right-of-way that is
17        not an interstate highway;
18             (3.1)  not allow a person under the age of 18 to  be
19        a  member  of the group who would be volunteering for the
20        purpose of litter collection along an interstate highway;
21             (4)  require all group members to  attend  a  safety
22        meeting  conducted  by  the group before participation in
23        any litter collection along an adopted section;
24             (5)  require the group coordinator, or designee,  to
25        conduct  group  safety  meetings  and  to  receive safety
26        training as required by the sponsoring jurisdiction;
27             (6)  adopt a section for a minimum of 2 years;
28             (7)  collect litter along an adopted section 4 times
29        a year, or as required by the director;
30             (8)  require the group coordinator to provide  prior
31        notice,  as  required by the director, whenever the group
32        intends to collect litter along its adopted section;
33             (9)  require group  members  to  properly  wear  any

 1        safety  apparel  provided  by the sponsoring jurisdiction
 2        while collecting litter on an adopted section;
 3             (10)  be responsible for  prohibiting  members  from
 4        possessing,  consuming,  or  being under the influence of
 5        alcohol or drugs while on an adopted section;
 6             (11)  maintain  a  first-aid  kit  and  an  adequate
 7        supply of drinking water  while  members  are  collecting
 8        litter along an adopted section;
 9             (12)  place  litter  in  trashbags  provided  by the
10        sponsoring jurisdiction and place filled trashbags  at  a
11        location  on  the  adopted  section  as designated by the
12        director; and
13             (13)  not  subcontract  or  assign  its  duties   or
14        responsibilities to any other group or organization.
