AMENDMENT TO HOUSE BILL 853

    AMENDMENT NO. ______. Amend House Bill 853, AS AMENDED, 
3
with reference to page and line numbers of Senate Amendment No. 
4
1, on page 6, immediately below line 14, by inserting the 
5
following:
6
    "Beginning on July 1, 2004, in case of a sale of dyed 
7
diesel fuel for use in the operation of ships, barges, or 
8
vessels that are used for the transportation of property on 
9
waters in this State, the distributor shall show in his or her 
10
return the amount of invoiced gallons of dyed diesel fuel sold 
11
and the name and address of the purchaser in addition to any 
12
other information the Department may require."; and

 
13
on page 7, line 33, by deleting "and"; and
 
14
on page 8, line 4, immediately after "Department", by inserting 
15
the following:
16
"; and (10) beginning on July 1, 2004, if a sale of dyed diesel 
17
fuel is made for use in the operation of ships, barges, or 
18
vessels that are used for the transportation of property on 
19
waters in this State, by making a specific notation thereof on 
20
the invoice or sales slip covering that sale and obtaining any 
21
supporting documentation as may be required by the Department"; 
22
and
 
23
on page 12, immediately below line 19, by inserting the

following:

    and keep the supporting documentation in such form as the 
30

on page 19, line 11, by replacing "9" with "10"; and

on page 20, immediately below line 30, by inserting the 
3
following:

        "10. Beginning on July 1, 2004, when a sale of dyed 
5
    diesel fuel is made for use in the operation of ships, 
6
    barges, or vessels that are used for the transportation of 
7
    property on waters in this State, by making a specific 
8
    notation thereof on the invoice or sales slip covering that 
9
    sale and obtaining any supporting documentation as may be 
10
    required by the Department. The supplier shall obtain and 
11
    keep the supporting documentation in such form as the 
12
    Department may require by rule.".
