| Sec. 6.5. Health benefits for TRS benefit recipients and | | 9 |
| TRS dependent
beneficiaries.
| | 10 |
| (a) Purpose. It is the purpose of this amendatory Act of | | 11 |
| 1995 to transfer
the administration of the program of health | | 12 |
| benefits established for benefit
recipients and their | | 13 |
| dependent beneficiaries under Article 16 of the Illinois
| | 14 |
| Pension Code to the Department of Central Management Services.
| | 15 |
| (b) Transition provisions. The Board of Trustees of the | | 16 |
| Teachers'
Retirement System shall continue to administer the | | 17 |
| health benefit program
established under Article 16 of the | | 18 |
| Illinois Pension Code through December 31,
1995. Beginning | | 19 |
| January 1, 1996, the Department of Central Management Services
| | 20 |
| shall be responsible for administering a program of health | | 21 |
| benefits for TRS
benefit recipients and TRS dependent | | 22 |
| beneficiaries under this Section.
The Department of Central | | 23 |
| Management Services and the Teachers' Retirement
System shall | | 24 |
| cooperate in this endeavor and shall coordinate their |

| activities
so as to ensure a smooth transition and | | 2 |
| uninterrupted health benefit coverage.
| | 3 |
| (c) Eligibility. All persons who were enrolled in the | | 4 |
| Article 16 program at
the time of the transfer shall be | | 5 |
| eligible to participate in the program
established under this | | 6 |
| Section without any interruption or delay in coverage
or | | 7 |
| limitation as to pre-existing medical conditions. Eligibility | | 8 |
| to
participate shall be determined by the Teachers' Retirement | | 9 |
| System.
Eligibility information shall be communicated to the | | 10 |
| Department of Central
Management Services in a format | | 11 |
| acceptable to the Department.
| | 12 |
| A TRS dependent beneficiary who is an unmarried child age | | 13 |
| 19 or over and
mentally or physically disabled
handicapped does | | 14 |
| not become ineligible to participate
by reason of (i) becoming | | 15 |
| ineligible to be claimed as a dependent for Illinois
or federal | | 16 |
| income tax purposes or (ii) receiving earned income, so long as
| | 17 |
| those earnings are insufficient for the child to be fully | | 18 |
| self-sufficient.
| | 19 |
| (d) Coverage. The level of health benefits provided under | | 20 |
| this Section
shall be similar to the level of benefits provided | | 21 |
| by the
program previously established under Article 16 of the | | 22 |
| Illinois Pension Code.
| | 23 |
| Group life insurance benefits are not included in the | | 24 |
| benefits
to be provided to TRS benefit recipients and TRS | | 25 |
| dependent beneficiaries under
this Act.
| | 26 |
| The program of health benefits under this Section may | | 27 |
| include any or all of
the benefit limitations, including but | | 28 |
| not limited to a reduction in benefits
based on eligibility for | | 29 |
| federal medicare benefits, that are provided under
subsection | | 30 |
| (a) of Section 6 of this Act for other health benefit programs | | 31 |
| under
this Act.
| | 32 |
| (e) Insurance rates and premiums. The Director shall | | 33 |
| determine the
insurance rates and premiums for TRS benefit | | 34 |
| recipients and TRS dependent
beneficiaries,
and shall present |

| to the Teachers' Retirement System of
the State of Illinois, by | | 2 |
| April 15 of each calendar year, the rate-setting

to determine the amount of the health care premiums.
| | 5 |
| For Fiscal Year 1996, the premium shall be equal to the | | 6 |
| premium actually
charged in Fiscal Year 1995; in subsequent | | 7 |
| years, the premium shall
never be lower than the premium | | 8 |
| charged in Fiscal Year 1995. | | 9 |
| For Fiscal Year
2003, the premium shall not exceed 110% | | 10 |
| of the premium actually charged in
Fiscal Year 2002. | | 11 |
| For Fiscal Year 2004, the premium shall not exceed 112% | | 12 |
| of
the premium actually charged in Fiscal Year 2003.
| | 13 |
| For Fiscal Year 2005, the premium shall not exceed a | | 14 |
| weighted average of 106.6% of

| in Fiscal Year 2004.

| For Fiscal Year 2006, the premium shall not exceed a | | 17 |
| weighted average of 109.1% of
the premium actually charged | | 18 |
| in Fiscal Year 2005.
| | 19 |
| For Fiscal Year 2007, the premium shall not exceed a | | 20 |
| weighted average of 103.9% of
the premium actually charged | | 21 |
| in Fiscal Year 2006.
| | 22 |
| For Fiscal Year 2008 and thereafter, the premium in | | 23 |
| each fiscal year shall not exceed 105% of
the premium | | 24 |
| actually charged in the previous fiscal year.
| | 25 |
| Rates and premiums may be based in part on age and | | 26 |
| eligibility for federal
medicare coverage. However, the cost of | | 27 |
| participation for a TRS dependent
beneficiary who is an | | 28 |
| unmarried child age 19 or over and mentally or physically
| | 29 |
| disabled
handicapped shall not exceed the cost for a TRS | | 30 |
| dependent beneficiary who is
an unmarried child under age 19 | | 31 |
| and participates in the same major medical or
managed care | | 32 |
| program.

| The cost of health benefits under the program shall be paid | | 34 |

| with Fiscal Year 2007 and thereafter, for a TRS benefit | | 14 |

Health Insurance Security Fund if a managed care | | 17 |
| program is accessible, as
determined by the Department of | | 18 |

| (3) For a TRS benefit recipient selecting the major | | 20 |
| medical coverage
program, up to 75% of the total insurance | | 21 |
| rate shall be paid from the Teacher
Health Insurance | | 22 |
| Security Fund if a managed care program is not accessible, | | 23 |
| as
determined by the Teachers' Retirement System. | | 24 |
| Effective with Fiscal Year 2007 and thereafter, for a TRS | | 25 |
| benefit recipient selecting the major medical coverage
| | 26 |
| program, 75% of the total insurance rate shall be paid from | | 27 |
| the Teacher
Health Insurance Security Fund if a managed | | 28 |
| care program is not accessible, as
determined by the | | 29 |
| Department of Central Management Services.
| | 30 |
| (3.1) For a TRS dependent beneficiary who is Medicare | | 31 |
| primary and enrolled in a managed care plan, or the major | | 32 |
| medical coverage program if a managed care plan is not | | 33 |
| available, 25% of the total insurance rate shall be paid | | 34 |
| from the Teacher Health Security Fund as determined by the |

| Department of Central Management Services. For the purpose | | 2 |
| of this item (3.1), the term "TRS dependent beneficiary who | | 3 |
| is Medicare primary" means a TRS dependent beneficiary who | | 4 |
| is participating in Medicare Parts A and B.
| | 5 |
| (4) Except as otherwise provided in item (3.1), the
The
| | 6 |
| balance of the rate of insurance, including the entire | | 7 |
| premium of
any coverage for TRS dependent beneficiaries | | 8 |
| that has been elected, shall be
paid
by deductions | | 9 |
| authorized by the TRS benefit recipient to be withheld from | | 10 |
| his
or her monthly annuity or benefit payment from the | | 11 |
| Teachers' Retirement System;
except that (i) if the balance | | 12 |
| of the cost of coverage exceeds the amount of
the monthly | | 13 |
| annuity or benefit payment, the difference shall be paid | | 14 |
| directly
to the Teachers' Retirement System by the TRS | | 15 |
| benefit recipient, and (ii) all
or part of the balance of | | 16 |
| the cost of coverage may, at the school board's
option, be | | 17 |
| paid to the Teachers' Retirement System by the school board | | 18 |
| of the
school district from which the TRS benefit recipient | | 19 |
| retired, in accordance
with Section 10-22.3b of the School | | 20 |
| Code. The Teachers' Retirement System
shall promptly | | 21 |
| deposit all moneys withheld by or paid to it under this
| | 22 |
| subdivision (e)(4) into the Teacher Health Insurance | | 23 |
| Security Fund. These
moneys shall not be considered assets | | 24 |
| of the Retirement System.
| | 25 |
| (f) Financing. Beginning July 1, 1995, all revenues arising | | 26 |
| from the
administration of the health benefit programs | | 27 |
| established under Article 16 of
the Illinois Pension Code or | | 28 |
| this Section shall be deposited into the
Teacher Health | | 29 |
| Insurance Security Fund, which is hereby created as a
| | 30 |
| nonappropriated trust fund to be held outside the State | | 31 |
| Treasury, with the
State Treasurer as custodian. Any interest | | 32 |
| earned on moneys in the Teacher
Health Insurance Security Fund | | 33 |
| shall be deposited into the Fund.
| | 34 |
| Moneys in the Teacher Health Insurance Security
Fund shall |

| be used only to pay the costs of the health benefit program
| | 2 |
| established under this Section, including associated | | 3 |
| administrative costs, and
the costs associated with the health | | 4 |
| benefit program established under Article
16 of the Illinois | | 5 |
| Pension Code, as authorized in this Section. Beginning
July 1, | | 6 |
| 1995, the Department of Central Management Services may make
| | 7 |
| expenditures from the Teacher Health Insurance Security Fund | | 8 |
| for those costs.
| | 9 |
| After other funds authorized for the payment of the costs | | 10 |
| of the health
benefit program established under Article 16 of | | 11 |
| the Illinois Pension Code are
exhausted and until January 1, | | 12 |
| 1996 (or such later date as may be agreed upon
by the Director | | 13 |
| of Central Management Services and the Secretary of the
| | 14 |
| Teachers' Retirement System), the Secretary of the Teachers' | | 15 |
| Retirement System
may make expenditures from the Teacher Health | | 16 |
| Insurance Security Fund as
necessary to pay up to 75% of the | | 17 |
| cost of providing health coverage to eligible
benefit | | 18 |
| recipients (as defined in Sections 16-153.1 and 16-153.3 of the
| | 19 |
| Illinois Pension Code) who are enrolled in the Article 16 | | 20 |
| health benefit
program and to facilitate the transfer of | | 21 |
| administration of the health benefit
program to the Department | | 22 |
| of Central Management Services.
| | 23 |
| (g) Contract for benefits. The Director shall by contract, | | 24 |
| self-insurance,
or otherwise make available the program of | | 25 |
| health benefits for TRS benefit
recipients and their TRS | | 26 |
| dependent beneficiaries that is provided for in this
Section. | | 27 |
| The contract or other arrangement for the provision of these | | 28 |
| health
benefits shall be on terms deemed by the Director to be | | 29 |
| in the best interest of
the State of Illinois and the TRS | | 30 |
| benefit recipients based on, but not limited
to, such criteria | | 31 |
| as administrative cost, service capabilities of the carrier
or | | 32 |
| other contractor, and the costs of the benefits.
| | 33 |
| (g-5) Committee. A Teacher Retirement Insurance Program | | 34 |
| Committee shall be established, to consist of 10 persons |

| appointed by the Governor.
| | 2 |
| The Committee shall convene at least 4 times each year, and | | 3 |
| shall consider and make recommendations on issues affecting the | | 4 |
| program of health benefits provided under this
Section. | | 5 |
| Recommendations of the Committee shall be based on a consensus | | 6 |
| of the members of the Committee.
| | 7 |
| If the Teacher
Health Insurance Security Fund experiences a | | 8 |
| deficit balance based upon the contribution and subsidy rates | | 9 |
| established in this Section and Section 6.6 for Fiscal Year | | 10 |
| 2008 or thereafter, the Committee shall make recommendations | | 11 |
| for adjustments to the funding sources established under these | | 12 |
| Sections. | | 13 |
| (h) Continuation and termination of program. It is the | | 14 |
| intention of
the General Assembly that the program of health | | 15 |
| benefits provided under this
Section be maintained on an | | 16 |
| ongoing, affordable basis.
through June 30, 2004.
The program | | 17 |
| of health benefits provided under this Section is terminated on
| | 18 |
| July 1, 2004.
| | 19 |
| The program of health benefits provided under this Section | | 20 |
| may be amended by
the State and is not intended to be a pension | | 21 |
| or retirement benefit subject to
protection under Article XIII, | | 22 |
| Section 5 of the Illinois Constitution.
| | 23 |
| (i) Repeal. (Blank).
This Section is repealed on July 1, | | 24 |
| 2004.

| contributions toward the cost of annuitant and survivor health
| | 3 |
| benefits. These contributions shall be at the following rates:
| | 4 |
| until January 1, 2002, 0.5% of salary;
beginning January 1, | | 5 |
| 2002, 0.65% of salary;
beginning July 1, 2003, 0.75% of salary; | | 6 |
| beginning July 1, 2005, 0.80% of salary;
beginning July 1, | | 7 |
| 2007, a percentage of salary to be determined by the Department | | 8 |
| of Central Management Services by rule, which in each fiscal | | 9 |
| year shall not exceed 105% of the percentage of salary actually | | 10 |
| required to be paid in the previous fiscal year.
| | 11 |
| These contributions shall be deducted by the employer and | | 12 |
| paid to the System
as service agent for the Department of | | 13 |
| Central Management Services. The System
may use the same | | 14 |
| processes for collecting the contributions required by this
| | 15 |
| subsection that it uses to collect contributions received from | | 16 |
| school districts
and other covered employers under Sections | | 17 |
| 16-154 and 16-155 of the Illinois
Pension Code.
| | 18 |
| An employer may agree to pick up or pay the contributions | | 19 |
| required under
this subsection on behalf of the teacher; such | | 20 |
| contributions shall be deemed
to have to have been paid by the | | 21 |
| teacher. Beginning January 1, 2002, if
the employer does not | | 22 |
| directly pay the required member contribution, then the
| | 23 |
| employer shall reduce the member's salary by an amount equal to | | 24 |
| the required
contribution and shall then pay the contribution | | 25 |
| on behalf of the member.
This reduction shall not change the | | 26 |
| amounts reported as creditable earnings
to the Teachers' | | 27 |
| Retirement System.
| | 28 |
| A person who purchases optional service credit under | | 29 |
| Article 16 of the
Illinois Pension Code for a period after June | | 30 |
| 30, 1995 must also make a
contribution under this subsection | | 31 |
| for that optional credit, at the rate
provided in subsection | | 32 |
| (a), based on the salary used in

| service credit must be paid
in full before any annuity based on | | 4 |
| that credit begins.

| (a-5) Beginning January 1, 2002, every employer of a | | 6 |
| teacher (other than
an employer that is a department as defined | | 7 |
| in Section 3 of this Act) shall
pay an employer contribution | | 8 |
| toward the cost of annuitant and survivor health
benefits. | | 9 |
| These contributions shall be computed as follows:
| | 10 |
| (1) Beginning January 1, 2002 through June 30, 2003, | | 11 |
| the employer
contribution shall be equal to 0.4% of each | | 12 |
| teacher's salary.
| | 13 |
| (2) Beginning July 1, 2003, the employer contribution | | 14 |
| shall be equal to
0.5% of each teacher's salary.
| | 15 |
| (3) Beginning July 1, 2005, the employer contribution | | 16 |
| shall be equal to
0.6% of each teacher's salary.
| | 17 |
| (4) Beginning July 1, 2007, the employer contribution | | 18 |
| shall be a percentage of each teacher's salary to be | | 19 |
| determined by the Department of Central Management | | 20 |
| Services by rule, which in each fiscal year shall not | | 21 |
| exceed 105% of the percentage of each teacher's salary | | 22 |
| actually required to be paid in the previous fiscal year.
| | 23 |
| These contributions shall be paid by the employer to the | | 24 |
| System as service
agent for the Department of Central | | 25 |
| Management Services. The System may use
the same processes for | | 26 |
| collecting the contributions required by this subsection
that | | 27 |
| it uses to collect contributions received from school districts | | 28 |
| and other
covered employers under the Illinois Pension Code.
| | 29 |
| The school district or other employing unit may pay these | | 30 |
| employer
contributions out of any source of funding available | | 31 |
| for that purpose and
shall forward the contributions to the | | 32 |
| System on the schedule established
for the payment of member | | 33 |
| contributions.
| | 34 |
| (b) The Teachers' Retirement System shall promptly deposit |

| all moneys
collected under subsections (a) and (a-5) of this
| | 2 |
| Section into the Teacher Health Insurance Security Fund created | | 3 |
| in Section 6.5
of this Act. The moneys collected under this | | 4 |
| Section shall be used only for
the purposes authorized in | | 5 |
| Section 6.5 of this Act and shall not be considered
to be | | 6 |
| assets of the Teachers' Retirement System. Contributions made | | 7 |
| under this
Section are not transferable to other pension funds | | 8 |
| or retirement systems and
are not refundable upon termination | | 9 |
| of service.
| | 10 |
| (c) On or before November 15 of each year, the Board of | | 11 |
| Trustees of the
Teachers' Retirement System shall certify to | | 12 |
| the Governor, the Director of
Central Management Services, and | | 13 |
| the State Comptroller its estimate of the
total amount of | | 14 |
| contributions to be paid under subsection (a) of this Section
| | 15 |
| 6.6 for the next fiscal year. The amount certified shall be | | 16 |
| decreased or
increased each year by the amount that the actual | | 17 |
| active teacher contributions
either fell short of or exceeded | | 18 |
| the estimate used by the Board in making the
certification for | | 19 |
| the previous fiscal year. The certification shall include
a | | 20 |
| detailed explanation of the methods and information that the | | 21 |
| Board relied
upon in preparing its estimate. As soon as | | 22 |
| possible after the effective date
of this amendatory Act of the | | 23 |
| 92nd General Assembly, the Board
shall recalculate and | | 24 |
| recertify its certifications for fiscal years 2002 and
2003.
| | 25 |
| (d) Beginning in fiscal year 1996, on the first day of each | | 26 |
| month, or
as soon thereafter as may be practical, the State | | 27 |
| Treasurer and the State
Comptroller shall transfer from the | | 28 |
| General Revenue Fund to the Teacher Health
Insurance Security | | 29 |
| Fund 1/12 of the annual amount appropriated for that fiscal
| | 30 |
| year to the State Comptroller for deposit into the Teacher | | 31 |
| Health Insurance
Security Fund under Section 1.3 of the State | | 32 |
| Pension Funds Continuing
Appropriation Act.
| | 33 |
| (e) Except where otherwise specified in this Section, the | | 34 |

| (a) After July 1, 1988, in addition to all other | | 20 |

| Section 34-6, administrative certificates shall be

A person who holds a valid and | | 25 |
| comparable out-of-state certificate, however, is not required | | 26 |
| to take a test of basic skills and is not required to take a | | 27 |
| test of subject matter knowledge, provided that the person has | | 28 |
| successfully passed a test of subject matter knowledge in | | 29 |
| another State or territory of the United States that is | | 30 |
| directly related in content to the specific subject area of | | 31 |
| certification. The tests of basic skills and subject matter

| knowledge shall be the tests which from time to time are | | 33 |

tests shall be designed to be racially | | 9 |
| neutral to assure that no
person in taking the tests is thereby | | 10 |
| discriminated against on the basis of

| origin or other factors unrelated to the person's

| perform as a certificated employee. The score required to pass
| | 13 |
| the tests of basic skills and subject matter knowledge shall be | | 14 |
| fixed by
the State Board of Education in consultation with the | | 15 |
| State Teacher
Certification Board. The tests shall be held not | | 16 |
| fewer than 3 times a year
at such time and place as may be | | 17 |
| designated by the State Board of Education
in consultation with | | 18 |
| the State Teacher Certification Board.

| (b) Except as provided in Section 34-6, the provisions of | | 20 |
| subsection
(a) of this Section shall apply equally in any | | 21 |
| school district subject to
Article 34, provided that the State | | 22 |
| Board of Education shall determine
which certificates issued | | 23 |
| under Sections 34-8.1 and 34-83 prior to July 1,

| Beginning with the 2002-2003 academic year, a student may | | 10 |
| not enroll
in a teacher preparation program at a recognized | | 11 |
| teacher training
institution until he or she has passed the | | 12 |
| basic skills test.
| | 13 |
| Beginning with the 2004-2005 academic year, a preservice
| | 14 |
| education teacher may not student teach until he or she has | | 15 |
| passed the
subject matter test in the discipline in which he or | | 16 |
| she will student
teach.
| | 17 |
| (e) The rules and regulations developed to implement the | | 18 |
| required test
of basic skills and subject matter knowledge | | 19 |
| shall include the requirements
of subsections (a), (b), and (c) | | 20 |
| and shall include specific regulations to
govern test | | 21 |
| selection; test validation and determination of a passing
| | 22 |
| score; administration of the tests; frequency of | | 23 |
| administration; applicant
fees; frequency of applicants' | | 24 |
| taking the tests; the years for which a
score is valid; and, | | 25 |
| waiving certain additional tests for additional
certificates | | 26 |
| to individuals who have satisfactorily passed the test of
basic | | 27 |
| skills and subject matter knowledge as required in subsection | | 28 |
| (a).
The State Board of Education shall provide, by rule, | | 29 |
| specific policies that
assure uniformity in the difficulty | | 30 |
| level of each form of the basic skills
test and each subject | | 31 |
| matter knowledge test from test-to-test and
year-to-year. The | | 32 |
| State Board of Education shall also set a passing
score for the | | 33 |

| required by the credit card processing company or vendor that | | 23 |
| has entered into a contract with the State Board or regional | | 24 |
| office of education for this purpose, and the fee must be paid | | 25 |
| to that company or vendor.

| Education in consultation with the State Teacher Certification | | 19 |
| Board, shall
be issued an Initial Teaching Certificate valid | | 20 |
| for 4 years of teaching, as
defined in Section 21-14 of this | | 21 |
| Code. Initial Teaching Certificates shall be
issued for | | 22 |
| categories corresponding to Early Childhood, Elementary, | | 23 |
| Secondary,
and Special K-12, with special certification | | 24 |

| completed 4 years of teaching. Upon completion of 4 years of | | 7 |
| teaching, the person is eligible for a Standard Certificate. | | 8 |
| Beginning July 1, 2004, an out-of-state candidate who has | | 9 |
| already earned a second-tier certificate in another state is | | 10 |
| not subject to any Standard Certificate eligibility | | 11 |

| Section other than completion of the 4 years of teaching. An | | 13 |
| out-of-state candidate who has completed less than 4 years of | | 14 |

| (2) of subsection (c) of this Section, proportionately reduced | | 17 |
| by the amount of time remaining to complete the 4 years of | | 18 |
| teaching.

| (c) Standard Certificate.

| (1) Persons who (i)
have completed 4 years of teaching, as | | 21 |
| defined in Section 21-14 of this Code,
with an Initial | | 22 |
| Certificate or an Initial Alternative Teaching Certificate and
| | 23 |
| have met all other criteria established by the State Board of | | 24 |
| Education in
consultation with the State Teacher Certification | | 25 |
| Board, (ii) have
completed 4

| Section, however, prohibits an induction or mentoring | | 10 |
| program from operating prior to approval. Holders of | | 11 |
| Initial Certificates issued before September 1, 2007 must | | 12 |
| complete, at a minimum, an approved one-year induction and | | 13 |
| mentoring program. Holders of Initial Certificates issued | | 14 |
| on or after September 1, 2007 must complete an approved | | 15 |
| 2-year induction and mentoring program. The plan must
| | 16 |
| describe the role of mentor teachers, the criteria and | | 17 |
| process for their
selection, and how all the following | | 18 |
| components are to be provided:
| | 19 |
| (i) Assignment of a formally trained mentor | | 20 |
| teacher to each new
teacher
for a specified period of | | 21 |
| time, which shall be established by the employing
| | 22 |
| school or school district but shall be at least 2 | | 23 |
| school years in duration,
provided that a mentor | | 24 |
| teacher may not directly or indirectly participate in
| | 25 |
| the evaluation of a new teacher pursuant to Article 24A | | 26 |
| of this Code or the
evaluation procedure of the school.
| | 27 |
| (ii) Formal mentoring for each new teacher.
| | 28 |
| (iii) Support for each new teacher in relation to | | 29 |
| the Illinois
Professional Teaching Standards, the | | 30 |
| content-area standards applicable to
the new teacher's | | 31 |
| area of certification, and any applicable local school
| | 32 |
| improvement and professional development plans.

| (iv) Professional development specifically | | 34 |
| designed to foster the
growth of each new teacher's |

| institution of higher
education, by such an institution in | | 22 |
| partnership with a teachers' association
or union or with a | | 23 |
| regional office of education, or by another entity

| authorized to issue college credit; and must include | | 25 |
| demonstration of

| activities for each of the Illinois

| (7) The changes made to paragraphs (1) through (5) of this | | 23 |
| subsection (c) by this amendatory Act of the 93rd General | | 24 |
| Assembly shall apply to those persons who hold or are eligible | | 25 |
| to hold an Initial Certificate on or after the effective date | | 26 |
| of this amendatory Act of the 93rd General Assembly and shall | | 27 |
| be given effect upon their application for a Standard | | 28 |
| Certificate.

| (8) Beginning July 1, 2004, persons who hold a Standard | | 30 |
| Certificate and have acquired one master's degree in an | | 31 |

| Teacher Certification Board. However, each teacher who holds a

| Master Certificate shall be eligible for a teaching position in | | 20 |
| this State in
the areas for which he or she holds a Master | | 21 |
| Certificate without satisfying any
other requirements of this | | 22 |
| Code, except for those requirements pertaining to
criminal | | 23 |
| background checks. A holder of a Master Certificate in an area | | 24 |
| of science or social science is eligible to teach in any of the | | 25 |
| subject areas within those fields, including those taught at | | 26 |

| levels of student performance in their schools.

| certificate holder is employed as an

| schools may appeal that determination to the State

| through the process outlined in
paragraphs (3) and (4) of | | 7 |
| this subsection (c-10).

| (6) Evidence of completion of the activities in the
| | 9 |
| administrative certificate renewal plan must be submitted | | 10 |
| to the
responsible reviewer or review panel. Before the | | 11 |
| expiration of the
administrative certificate, the | | 12 |
| certificate holder must request from
the responsible | | 13 |
| reviewer or review panel a signed verification form
| | 14 |
| developed by the State Board of Education confirming that | | 15 |
| the
certificate holder has met the requirements for renewal | | 16 |
| contained
in this Section. A certificate holder who is not | | 17 |
| a regional
superintendent of schools must submit this form | | 18 |
| to the responsible
regional superintendent of schools (or | | 19 |
| his or her designee) at the
time of application for renewal | | 20 |
| of the certificate. A certificate holder
who is a regional | | 21 |
| superintendent of schools must submit this form
for | | 22 |
| validation to the State Superintendent of Education (or his | | 23 |
| or
her designee) at the time of application for renewal of | | 24 |
| the certificate.
| | 25 |
| The certificate holder must complete a verification form | | 26 |
| developed by the State Board of Education and certify that 100 | | 27 |
| hours of continuing professional development activities and 5 | | 28 |
| Administrators' Academy courses have been completed.
(7) The | | 29 |
| regional superintendent of schools shall review and

| (c-15) This subsection (c-15) applies to the first period | | 15 |
| of an
administrative certificate's validity during which the | | 16 |
| holder becomes
subject to the requirements of subsection (c-10) | | 17 |
| of this Section if the
certificate has less than 5 years' | | 18 |
| validity or has less than 5 years' validity
remaining when the | | 19 |
| certificate holder becomes subject to the
requirements of | | 20 |
| subsection (c-10) of this Section. With respect to this
period, | | 21 |
| the 100 hours of continuing professional development and 5
| | 22 |
| activities per validity period specified in clause (A) of | | 23 |
| paragraph (2) of
subsection (c-10) of this Section shall | | 24 |
| instead be deemed to mean 20
hours of continuing professional | | 25 |
| development and one activity per year of
the certificate's | | 26 |
| validity or remaining validity and the 30

| professional development hours specified in clause (B) of | | 28 |

renewal of administrative certificates. Failure to submit | | 10 |
| satisfactory evidence
of continuing professional education | | 11 |
| which contributes to promoting the goals
of this Section shall | | 12 |
| result in a loss of administrative certification.
| | 13 |
| (d) Any limited or life supervisory certificate issued | | 14 |
| prior to July 1, 1968
shall continue to be valid for all | | 15 |
| administrative and supervisory positions
in the public schools | | 16 |
| for which it is valid as of that date as long as its
holder | | 17 |
| meets the requirements for registration or renewal as set forth | | 18 |
| in
the statutes or until revoked according to law.
| | 19 |
| (e) The administrative or supervisory positions for which | | 20 |
| the certificate
shall be valid shall be determined by one or | | 21 |
| more of 3 endorsements: general
supervisory, general | | 22 |
| administrative and superintendent.
| | 23 |
| Subject to the provisions of Section 21-1a, endorsements | | 24 |
| shall be
made under conditions set forth in this Section. The | | 25 |
| State Board of
Education shall, in consultation with the State | | 26 |
| Teacher Certification
Board, adopt rules pursuant to the | | 27 |
| Illinois Administrative Procedure Act,
establishing | | 28 |
| requirements for obtaining administrative certificates where
| | 29 |
| the minimum administrative or supervisory requirements surpass | | 30 |
| those set
forth in this Section.

| The State Teacher Certification Board shall file with the | | 32 |
| State Board of
Education a written recommendation when | | 33 |
| considering additional
administrative or supervisory | | 34 |

| not be limited to, those used by the State

| in determining whether additional knowledge will be

| Additionally, the State Board of Education shall in | | 10 |
| consultation
with the State Teacher Certification Board, | | 11 |
| establish provisions within its
rules whereby any member of the | | 12 |
| educational community or the public may
file a formal written | | 13 |
| recommendation or inquiry regarding requirements.
| | 14 |
| (1) Until July 1, 2003, the general supervisory | | 15 |
| endorsement shall be
affixed to the
administrative | | 16 |
| certificate of any holder who has at least 16 semester | | 17 |
| hours
of graduate credit in professional education | | 18 |
| including 8 semester hours of
graduate credit in curriculum | | 19 |
| and research and who has at least 2 years of
full-time | | 20 |
| teaching experience or school service personnel experience | | 21 |
| in
public schools, schools under the supervision of the | | 22 |
| Department of Corrections,
schools under the | | 23 |
| administration of the Department of
Rehabilitation | | 24 |
| Services, or nonpublic schools meeting the standards
| | 25 |
| established by the State Superintendent of Education or | | 26 |
| comparable out-of-state
recognition standards approved by | | 27 |
| the State Superintendent of Education.
| | 28 |
| Such endorsement shall be required for supervisors, | | 29 |
| curriculum directors

| be entitled to receive an administrative certificate

| general administrative endorsement affixed thereto if he | | 22 |
| or she: (i)
had at least 3 years of experience as a | | 23 |
| certified teacher for such district
prior to August 1, | | 24 |
| 1985; (ii) obtained a Master's degree prior to August 1,

| 1985; (iii) completed at least 20 hours of graduate credit | | 26 |
| in education
courses (including at least 12 hours in | | 27 |

supervision) prior to | | 28 |
| September 1, 1987; and (iv) has received a rating of

| superior for at least each of the last 5 years. Any person | | 30 |
| who obtains an

| master's degree in a program for the preparation of

| superintendents of schools including 16 semester hours of | | 21 |
| graduate credit
in professional education and who has at | | 22 |
| least 2 years experience as an
administrator or supervisor | | 23 |
| in the public schools or the State Board of
Education or | | 24 |
| education service regions or in nonpublic schools meeting | | 25 |
| the
standards established by the State Superintendent of | | 26 |
| Education or
comparable out-of-state recognition standards | | 27 |

| periods without penalty. Initial Certificates that are not | | 16 |
| registered shall lapse consistent with subsection (a) of this | | 17 |
| Section and may be reinstated only in accordance with | | 18 |
| subsection (a).
Standard Teaching Certificates are renewable | | 19 |

in
subsection (c) of Section 21-2

| "teaching" is defined as employment and

| superintendent to submit recommendations to him or her for this | | 16 |
| purpose. The statement of assurance shall contain a list of the | | 17 |
| activities completed, the provider offering each activity, the | | 18 |
| number of credits earned for each activity, and the purposes to | | 19 |
| which each activity is attributed. The certificate holder shall | | 20 |
| maintain the evidence of completion of each activity for at | | 21 |
| least one certificate renewal cycle. The certificate holder | | 22 |
| shall affirm under penalty of perjury that he or she has | | 23 |
| completed the activities listed and will maintain the required | | 24 |
| evidence of completion. The State Board of Education or the | | 25 |
| regional superintendent of schools for each region shall | | 26 |
| conduct random audits of assurance statements and supporting | | 27 |
| documentation.
A certificate renewal plan must initially be | | 28 |
| approved by the
certificate holder's
local professional | | 29 |
| development committee, as provided for in subsection (f) of
| | 30 |
| this
Section. If the local professional development committee | | 31 |
| does not approve the
certificate renewal plan, the certificate | | 32 |
| holder may appeal that determination
to the
regional | | 33 |
| professional development review committee, as provided for in
| | 34 |
| paragraph (2)
of
subsection (g) of this Section. If the |

| cases, the regional professional development

| shall immediately notify both the local professional | | 13 |
| development
committee
and
the certificate holder of its | | 14 |
| determination.

A certificate holder who wishes to modify the | | 16 |
| continuing professional
development activities or goals in his | | 17 |
| or her certificate renewal plan must
submit the
proposed | | 18 |
| modifications to his or her local professional development | | 19 |
| committee
for
approval prior to engaging in the proposed | | 20 |
| activities. If the local
professional
development committee | | 21 |
| does not approve the proposed modification, the
certificate
| | 22 |
| holder may appeal that determination to the regional | | 23 |
| professional development
review
committee, as set forth in | | 24 |
| paragraph (4) of this subsection (e).
| | 25 |
| (6) (Blank).
When a certificate holder changes assignments | | 26 |
| or school districts
during
the course of completing a | | 27 |
| certificate renewal plan, the professional
development and | | 28 |
| continuing education credit earned pursuant to the plan shall
| | 29 |
| transfer
to the
new assignment or school district and count | | 30 |
| toward the total requirements.
This certificate renewal plan | | 31 |
| must be
reviewed by
the appropriate local professional | | 32 |
| development committee and may be modified to
reflect the | | 33 |
| certificate holder's new work assignment or the school | | 34 |
| improvement
plan of
the new school district or school building.

| (f) Notwithstanding any other provisions of this Code, a | | 2 |
| school district is authorized to enter into an agreement with | | 3 |
| the exclusive bargaining representative, if any, to form a | | 4 |
| local professional development committee (LPDC). The | | 5 |
| membership and terms of members of the LPDC may be determined | | 6 |
| by the agreement. Provisions regarding LPDCs contained in a | | 7 |
| collective bargaining agreement in existence on the effective | | 8 |
| date of this amendatory Act of the 93rd General Assembly | | 9 |
| between a school district and the exclusive bargaining | | 10 |
| representative shall remain in full force and effect for the | | 11 |
| term of the agreement, unless terminated by mutual agreement. | | 12 |
| The LPDC shall make recommendations to the regional | | 13 |
| superintendent of schools on renewal of teaching certificates. | | 14 |
| The regional superintendent of schools for each region
each | | 15 |
| school district,
charter school, and cooperative or joint | | 16 |
| agreement
with a
governing body or board of control that | | 17 |
| employs certificated staff, shall
establish and implement, in
| | 18 |
| conjunction with its exclusive representative, if any, one or | | 19 |
| more local
professional
development committees, as set forth in | | 20 |
| this subsection (f), which shall
perform
the following | | 21 |
| functions:

review recommendations for

| renewal, if any, received from LPDCs plans and any

| recommendation for renewal or nonrenewal he or she receives | | 16 |

| within 14 days of receipt of the
recommendation,

| following, if applicable:

| (A) the certificate holder has satisfactorily | | 21 |

| committee member to attend regional

| review committee meetings.

| In a city having a population exceeding 500,000 that does | | 18 |
| not have a regional
office of education, one or more separate | | 19 |
| regional professional development
review
committees shall be | | 20 |
| established as mutually agreed upon by the board of

the school district organized under Article 34 of this Code | | 22 |
| and the exclusive
representative. The composition of each | | 23 |
| committee shall be the same as for a
regional

| Neglected Child Reporting Act.

| The regional superintendent or State Superintendent of | | 26 |
| Education shall,

| the same fees and mileage and
in the same manner as prescribed | | 27 |
| by law in judicial proceedings in the
civil cases in circuit | | 28 |
| courts of this State.
