093_HB1460eng HB1460 Engrossed LRB093 03992 EFG 04031 b 1 AN ACT in relation to the Metropolitan Water Reclamation 2 District. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Metropolitan Water Reclamation District 6 Act is amended by changing Section 4.32 as follows: 7 (70 ILCS 2605/4.32) (from Ch. 42, par. 323.32) 8 Sec. 4.32. Veteran's preference. 9 (a) A person who served in the National Guard or the 10 United States Army, Navy, Air Force, Marine Corps, Coast 11 Guard, or Reserves and was honorably discharged from that 12 service or who is currently serving in the National Guard or 13 the Reserves is entitled to a veteran's preference under this 14 Section. 15 (b) The Director of Personnel shall give preference for 16 an original or promotional appointment to a person qualifying 17 for a veteran's preference under this Section whose name 18 appears on an original or promotional eligible register by 19 adding 5 points to the final grade that the person receives 20 as the result of any original or promotional examination held 21 on or after the effective date of this amendatory Act of the 22 93rd General Assembly. 23 (c) The changes made to this Section by this amendatory 24 Act of the 93rd General Assembly are not intended to affect 25 any preference granted under this Section before the 26 effective date of this amendatory Act. 27Persons who were engaged in the military or naval service28of the United States during the years 1898, 1899, 1900, 1901,291902, 1914, 1915, 1916, 1917, 1918, or 1919, any time between30September 16, 1940 and July 25, 1947, or any time during the31national emergency between June 25, 1950 and January 31,HB1460 Engrossed -2- LRB093 03992 EFG 04031 b 11955, and who were honorably discharged therefrom, and all2persons who were engaged in such military or naval service3during any of said years, any time between September 16, 19404and July 25, 1947, or any time during the national emergency5between June 25, 1950 and January 31, 1955, or any time from6August 5, 1964 until the date determined by the Congress of7the United States as the end of Viet Nam hostilities, or at8any time between August 6, 1990 and the date the Persian Gulf9Conflict ends as prescribed by Presidential proclamation or10order, who are now or may hereafter be on inactive or reserve11duty in such military or naval service, not including,12however, persons who were convicted by court-martial of13disobedience of orders, where such disobedience consisted in14the refusal to perform military service on the ground of15alleged religious or conscientious objections against war,16shall be preferred for appointments to offices, positions and17places of employment in the classified service of the18District, provided they are found to possess the business19capacity necessary for the proper discharge of the duties of20such office, position, or place of employment as determined21by examination for original entrance. The Director of22Personnel on certifying from any existing register of23eligibles resulting from the holding of an examination for24original entrance or any register of eligibles that may be25hereafter created of persons who have taken and successfully26passed the examinations provided for in this Act for original27entrance commenced prior to September 1, 1949, shall place28the name or names of such persons at the head of any existing29eligible register or list of eligibles that shall be created30under the provisions of this Act to be certified for31appointment. The Director of Personnel shall give preference32for original appointment to persons as hereinabove designated33whose names appear on any register of eligibles resulting34from an examination for original entrance held under theHB1460 Engrossed -3- LRB093 03992 EFG 04031 b 1provisions of this Act and commenced on or after September 1,21949 by adding to the final grade average which they received3or will receive as the result of any examination held for4original entrance, five points. The numerical result thus5attained shall be applied by the Director of Personnel in6determining the position of such persons on any eligible list7which has been created as the result of any examination for8original entrance commenced on or after September 1, 1949 for9purposes of preference in certification and appointment from10such eligible list.11Every certified Civil Service employee who was called to,12or who volunteered for, the military or naval service of the13United States at any time during the years specified in this14Act, or at any time between September 16, 1940 and July 25,151947 or any time during the national emergency between June1625, 1950 and January 31, 1955, or any time from August 5,171964 until the date determined by Congress of the United18States as the end of Viet Nam hostilities, or at any time19between August 6, 1990 and the date the Persian Gulf conflict20ends as prescribed by Presidential proclamation or order, and21who were honorably discharged therefrom or who are now or who22may hereafter be on inactive or reserve duty in such military23or naval service, not including, however, persons who were24convicted by court martial of disobedience of orders where25such disobedience consisted in the refusal to perform26military service on the ground of alleged religious or27conscientious objections against war, and whose names appear28on existing promotional eligible registers or any promotional29eligible register that may hereafter be created, as provided30for by this Act, shall be preferred for promotional31appointment to civil offices, positions and places of32employment in the classified civil service of the District33coming under the provisions of this Act.34The Director of Personnel shall give preference forHB1460 Engrossed -4- LRB093 03992 EFG 04031 b 1promotional appointment to persons as hereinabove designated2whose names appear on existing promotional eligible registers3or promotional eligible registers that may hereafter be4created by adding to the final grade average which they5received or will receive as the result of any promotional6examination commencing prior to September 1, 19497three-fourths of one point for each 6 months or fraction8thereof of military or naval service not exceeding 48 months,9and by adding to the final grade average which they will10receive as the result of any promotional examination held11commencing on or after September 1, 1949 seven-tenths of one12point for each 6 months or fraction thereof of military or13naval service not exceeding 30 months. The numerical result14thus attained shall be applied by the Director of Personnel15in determining the position of such persons on any eligible16list which has been created or will be created as the result17of any promotional examination held hereunder for purposes of18preference in certification and appointment from such19eligible list.20No person shall receive the preference for a promotional21appointment granted by this Section after he has received one22promotion from an eligible list on which he was allowed such23preference and which was prepared as a result of an24examination held on or after September 1, 1949.25No person entitled to preference or credit for military26or naval service hereunder shall be required to furnish27evidence or record of honorable discharge from the armed28forces before any examination held under the provisions of29this Act but such preference shall be given after the posting30or publication of the eligible list or register and before31any certification or appointments are made from the eligible32register.33 (Source: P.A. 86-324; 87-945.)
