093_HB2447 LRB093 08536 DRJ 08762 b 1 AN ACT in relation to mental health. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Mental Health and Developmental 5 Disabilities Administrative Act is amended by adding Section 6 72 as follows: 7 (20 ILCS 1705/72 new) 8 Sec. 72. DuPage County intermittent care group homes; 9 pilot project. 10 (a) Definition. In this Section, "Service Provider" 11 means Trinity Services of Joliet, Illinois. 12 (b) The Department shall establish in DuPage County, as 13 a pilot project, 2 group homes, each housing 4 residents with 14 similar diagnoses of mental illness and requiring similar 15 intermittent care. The homes must be located in DuPage County 16 and within reasonable proximity of each other. The homes must 17 have similar characteristics and be approved by the United 18 States Department of Housing and Urban Development for 19 Section 8 Project-Based Assistance. 20 (c) The Department shall purchase each home with 21 down-payment moneys provided by (i) the family of one of the 22 home's residents through an established special needs trust 23 and (ii) a not-for-profit provider of services for the 24 mentally ill. 25 (d) The Department shall rent each home to the Service 26 Provider at a fair market rental value as determined by the 27 DuPage Housing Authority. The rent must cover payment of 28 principal and interest on the mortgage on each home, as well 29 as payment of taxes and insurance on the properties and the 30 cost of reasonably expected repairs and maintenance. 31 (e) The Service Provider shall pay all principal and -2- LRB093 08536 DRJ 08762 b 1 interest under the mortgage on each of the homes as those 2 amounts come due and shall pay the cost of property taxes and 3 insurance on the homes and the cost of repairs and 4 maintenance on the homes. The Service Provider shall pay for 5 utility service to the homes. 6 (f) The General Assembly anticipates that the United 7 States Department of Housing and Urban Development will pay 8 to the Service Provider a monthly amount as rent on behalf of 9 each resident. The Department also anticipates that residents 10 will pay rent monthly to the Service Provider in an amount 11 approved by the Department. The General Assembly anticipates 12 that the residents will be eligible for Food Stamps or other 13 forms of food assistance and that those benefits will be 14 applied toward the cost of food for each household. 15 (g) The Department shall contract with the Service 16 Provider to provide all necessary and customary services to 17 the residents of the homes. The Service Provider must ensure 18 that sufficient employees are assigned to each home to meet 19 the needs of the residents and to comply with the level of 20 care necessary for the residents. The Service Provider shall 21 also provide the residents of each home with transportation 22 to daily programs, social events, counseling, therapy, 23 physician appointments, and places of employment. 24 (h) The Department and the Service Provider must take 25 all steps necessary to enroll the residents of the homes as 26 recipients of medical assistance under Article V of the 27 Illinois Public Aid Code and to seek reimbursement under that 28 program for services provided to the residents.
