093_HB3512eng HB3512 Engrossed LRB093 03707 SJM 12188 b 1 AN ACT concerning finance. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The State Prompt Payment Act is amended by 5 adding Section 8 as follows: 6 (30 ILCS 540/8 new) 7 Sec. 8. Priority of payment. 8 (a) Definition. As used in this Section, "qualified 9 provider" means a not-for-profit organization that provides 10 non-residential services for the mentally ill or 11 developmentally disabled and is reimbursed or otherwise paid 12 for providing those services by the Illinois Department of 13 Human Services. A "qualified provider" does not include a 14 hospital licensed under the Hospital Licensing Act, a 15 long-term care facility licensed under the Nursing Home Care 16 Act only with respect to services provided in the licensed 17 facility to residents, or a local governmental unit or 18 university. A "qualified provider" also includes an entity 19 licensed under the Community-Integrated Living Arrangements 20 Licensure and Certification Act, but only with respect to the 21 services provided for a community-integrated living 22 arrangement. The Department of Human Services shall make the 23 determination of who is a "qualified provider". 24 (b) Processing by official or agency. Except as provided 25 in subsection (d), a bill or invoice for goods or services 26 furnished to the State submitted by a qualified provider and 27 a grant award payment to a qualified provider must be given 28 priority in processing. Any bill or invoice and any grant 29 award payment meeting these criteria that is submitted to an 30 official or agency must be processed and forwarded for 31 payment before any other bill, invoice, or grant award HB3512 Engrossed -2- LRB093 03707 SJM 12188 b 1 payment is processed or forwarded for payment. 2 (c) Payment by Comptroller. Except as provided in 3 subsection (d), a voucher for payment for goods or services 4 furnished to the State by a qualified provider and a grant 5 award payment to a qualified provider submitted by an 6 official or agency to the Comptroller for payment must be 7 given priority in payment. Any voucher meeting these criteria 8 that is submitted to the Comptroller by an official or agency 9 for payment from a given fund must be paid before any other 10 bill, invoice, or grant award is paid from that fund. If 2 or 11 more vouchers eligible for priority payment are received by 12 the Comptroller in the same day for payment out of the same 13 fund and there is not enough money in the fund to pay them 14 all, then each bill, invoice, or grant award shall be paid in 15 the order in which it is received. 16 (d) The processing and payment of (i) debt service 17 obligations of the State and (ii) payroll obligations of the 18 State shall have priority over the processing and payment of 19 items as required by this Section. 20 Section 99. Effective date. This Act takes effect upon 21 becoming law.
