1 AN ACT regarding higher education.
2 Whereas, individual Illinois public universities have
3 discretion to formulate their own specific policies on
4 in-state tuition for military personnel whose state of
5 residence is not Illinois; and
6 Whereas, Illinois public universities have adopted
7 generous policies for soldiers and family members within the
8 state of legal residence and in the state of assignment; and
9 Whereas, these policies currently exclude continuity of
10 in-state tuition for military personnel and their dependents
11 once established; and
12 Whereas, the General Assembly urges the Board of Trustees
13 of each public university in the State to adopt a policy
14 ensuring that changes in permanent duty station to locations
15 outside of this State shall not affect the rate of tuition
16 that the member or his or her dependent is receiving as long
17 as the person is continuously enrolled at the university;
18 therefore
19 Be it enacted by the People of the State of Illinois,
20 represented in the General Assembly:
21 Section 5. The University of Illinois Act is amended by
22 changing Section 7e-5 as follows:
23 (110 ILCS 305/7e-5)
24 Sec. 7e-5. In-state tuition charge.
25 (a) Notwithstanding any other provision of law to the
26 contrary, for tuition purposes, the Board of Trustees shall
27 deem an individual an Illinois resident, until the individual
28 establishes a residence outside of this State, if all of the
29 following conditions are met:

1 (1) The individual resided with his or her parent
2 or guardian while attending a public or private high
3 school in this State.
4 (2) The individual graduated from a public or
5 private high school or received the equivalent of a high
6 school diploma in this State.
7 (3) The individual attended school in this State
8 for at least 3 years as of the date the individual
9 graduated from high school or received the equivalent of
10 a high school diploma.
11 (4) The individual registers as an entering student
12 in the University not earlier than the 2003 fall
13 semester.
14 (5) In the case of an individual who is not a
15 citizen or a permanent resident of the United States, the
16 individual provides the University with an affidavit
17 stating that the individual will file an application to
18 become a permanent resident of the United States at the
19 earliest opportunity the individual is eligible to do so.
20 (b) This subsection (a) Section applies only to tuition
21 for a term or semester that begins on or after May 20, 2003
22 (the effective date of Public Act 93-7) this amendatory Act
23 of the 93rd General Assembly. Any revenue lost by the
24 University in implementing this subsection (a) Section shall
25 be absorbed by the University Income Fund.
26 (b) The tuition rate for a member or dependent of a
27 member of the (i) Illinois National Guard, (ii) United States
28 Coast Guard, or (iii) United States Armed Forces must not
29 exceed the tuition rate for Illinois residents if the member
30 is on active duty for a period of more than 30 days and the
31 member's domicile or permanent duty station is in this State.
32 Within 90 days after this amendatory Act of the 93rd General
33 Assembly becomes law, the Board of Trustees shall adopt a
34 policy governing the tuition rate for persons who no longer

1 qualify for the tuition rate established in this subsection
2 (b) but who remain continuously enrolled at the University,
3 and shall report this policy to the Board of Higher
4 Education.

6 Section 10. The Southern Illinois University Management
7 Act is amended by changing Section 8d-5 as follows:

9 Sec. 8d-5. In-state tuition charge.
10 (a) Notwithstanding any other provision of law to the
11 contrary, for tuition purposes, the Board shall deem an
12 individual an Illinois resident, until the individual
13 establishes a residence outside of this State, if all of the
14 following conditions are met:
15 (1) The individual resided with his or her parent
16 or guardian while attending a public or private high
17 school in this State.
18 (2) The individual graduated from a public or
19 private high school or received the equivalent of a high
20 school diploma in this State.
21 (3) The individual attended school in this State
22 for at least 3 years as of the date the individual
23 graduated from high school or received the equivalent of
24 a high school diploma.
25 (4) The individual registers as an entering student
26 in the University not earlier than the 2003 fall
