093_HB3860 LRB093 13529 DRH 18868 b 1 AN ACT concerning vehicles. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Illinois Vehicle Code is amended by 5 changing Section 3-815.1 as follows: 6 (625 ILCS 5/3-815.1) 7 Sec. 3-815.1. Commercial distribution fee. 8 (1) Beginning July 1, 2003, in addition to any tax or 9 fee imposed under this Code: 10 (a) Vehicles of the second division with a gross 11 vehicle weight that exceeds 8,000 pounds and that incur 12 any tax or fee under subsection (a) of Section 3-815 of 13 this Code or subsection (a) of Section 3-818 of this 14 Code, as applicable,andshall pay to the Secretary of 15 State a commercial distribution fee, for each 16 registration year, for the use of the public highways, 17 State infrastructure, and State services, in an amount 18 equal to 36% of the taxes and fees incurred under 19 subsection (a) of Section 3-815 of this Code, or 20 subsection (a) of Section 3-818 of this Code, as 21 applicable, rounded up to the nearest whole dollar. 22 (b) Vehicles of the second division with a gross 23 vehicle weight of 8,000 pounds or less and that incur any 24 tax or fee under subsection (a) of Section 3-815 of this 25 Code or subsection (a) of Section 3-818 of this Code, as 26 applicable, and have claimed the rolling stock exemption 27 under the Retailers' Occupation Tax Act, Use Tax Act, 28 Service Occupation Tax Act, or Service Use Tax Act shall 29 pay to the Illinois Department of Revenue (or the 30 Secretary of State under an intergovernmental agreement) 31 a commercial distribution fee, for each registration -2- LRB093 13529 DRH 18868 b 1 year, for the use of the public highways, State 2 infrastructure, and State services, in an amount equal to 3 36% of the taxes and fees incurred under subsection (a) 4 of Section 3-815 of this Code or subsection (a) of 5 Section 3-818 of this Code, as applicable, rounded up to 6 the nearest whole dollar. 7 The fees paid under this subsection (l)Sectionshall be 8 deposited by the Secretary of State into the General Revenue 9 Fund. 10 (2) Any person who has paid the distribution fee 11 collected under subsection (l) of this Section for fiscal 12 year 2004 is entitled to a full refund. 13 The Secretary shall adopt rules for implementing this 14 subsection (2). 15 (Source: P.A. 93-23, eff. 6-20-03; revised 10-9-03.) 16 Section 99.
