Amends the Illinois Vehicle Code. Provides that any school bus purchased on
or after January 1, 2005 to transport students to or from any school for
grades K through 12 supported in whole or in part by State funds must be
equipped to use
biodiesel fuel. Provides that any school bus used to transport students to or
from a
school covered
by the provision must use biodiesel fuel unless biodiesel fuel is unavailable
in the
vicinity of the school or unless the school bus is not equipped to use
biodiesel fuel.
Provides that the Secretary of Transportation shall adopt rules for
implementing the new provision.
Effective immediately. |

| Be it enacted by the People of the State of Illinois, |

| represented in the General Assembly:
|

| Section 5. The Illinois Vehicle Code is amended by adding |
5 |
| Section 12-812.2
as follows:
|

| (625 ILCS 5/12-812.2 new)
|

| Sec. 12-812.2. Use of biodiesel fuel required.
|

| (a) Any school bus purchased on or after January 1, 2005 |
9 |
| for
transportation of students to and from public schools and |
10 |
| all other educational
institutions in this State supported or |
11 |
| maintained, in whole or in part, by
public funds, which provide |
12 |
| instruction in any of the grades from kindergarten
through 12, |
13 |
| must be equipped to use biodiesel as defined in Section 10 of |
14 |
| the
Illinois Renewable Fuels Development Program Act.
|

| (b) Any school bus used to transport students to and from |
16 |
| any school
described in subsection (a) must use biodiesel |
17 |
| unless (i) biodiesel is not
available in the vicinity of the |
18 |
| school or (ii) the school bus is not equipped
for the use of |
19 |
| biodiesel.
|
20 |
| (c) The Secretary of Transportation shall adopt rules for |
21 |
| implementing this
Section.
|

| Section 99. Effective date. This Act takes effect upon |
23 |
| becoming law. |
