    AMENDMENT NO. ______. Amend House Bill 3977 on page 1, by

replacing line 1 with the following:

    "AN ACT concerning criminal history records checks."; and
 
5
on page 1, by replacing lines 5 and 6 with the following:

"Administrative Code of Illinois is amended  by changing 
7
Sections 2605-325 and 2605-330 as follows:"; and

on page 1, immediately below line 23, by inserting the 
9
following:

    "(20 ILCS 2605/2605-330)  (was 20 ILCS 2605/55a in part)

    Sec. 2605-330. Firefighter applicant criminal history 
12
records checks
background investigations. Upon
the request of 
13
the chief of a volunteer fire department or the board of 
14
trustees of a fire protection district, the Department shall

15
conduct fingerprint-based criminal history records checks of 
16
both State and Federal Bureau of Investigation criminal history 
17
record databases concerning
criminal background investigations 
18
of prospective firefighters and
report to the requesting chief 
19
or the board of trustees of a fire protection district any 
20
conviction information
any record of convictions maintained in 
21
the
Department's files about those persons.  The Department may 
22
charge the requesting chief or board of trustees a fee for 
23
conducting the criminal history records check. The fee shall be

deposited into the State Police Services Fund and shall not 
2
exceed the cost of the inquiry
a fee, based
on actual costs, 
3
for the dissemination of conviction information under this

4
Section.  The Department may prescribe the form and manner
for 
5
requesting and furnishing conviction information under this 
6
Section.
