| AN ACT concerning procurement.
|

| Be it enacted by the People of the State of Illinois,
|
| 3 |
| represented in the General Assembly:
|

| Section 5. The Illinois Procurement Code is amended by |
| 5 |
| adding Section 25-65 as follows: |
| 6 |
| (30 ILCS 500/25-65 new) |
| 7 |
| Sec. 25-65. Electronic mail service; spam free. Electronic |
| 8 |
| mail service provided under State contracts awarded on or after |
| 9 |
| the effective date of this amendatory Act of the 93rd General |
| 10 |
| Assembly must be provided reasonably free of unsolicited |
| 11 |
| electronic mail advertisements (sometimes known as "spam"). |
| 12 |
| The electronic mail service provider is responsible for using |
| 13 |
| software filters or other means to accomplish the requirements |
| 14 |
| of this Section. In this Section, the terms "electronic mail |
| 15 |
| service", "electronic mail service provider", and "unsolicited |
| 16 |
| electronic mail advertisement" have the same meanings as those |
| 17 |
| terms are defined in the Electronic Mail Act (815 ILCS 511/).
