SYNOPSIS AS INTRODUCED:
 		













720 ILCS 5/25-1.1









    Amends the Criminal Code of 1961.  Provides that a person commits the offense
of unlawful contact with streetgang members when he or she knowingly has direct
or
indirect contact with a streetgang member after having been ordered by a judge
in any
non-criminal proceeding to refrain from direct or indirect contact with a
streetgang
member or members or after having been released from the Illinois Department of
Corrections on a condition of parole or mandatory supervised release that he or
she
refrain from direct or indirect contact with a streetgang member or members.

    AN ACT concerning criminal law.

    Be it enacted by the People of the State of Illinois, 
3
represented in the General Assembly:

    Section 5. The Criminal Code of 1961 is amended by changing

5
Section 25-1.1 as follows:

    (720 ILCS 5/25-1.1)

7
    Sec. 25-1.1. Unlawful contact with streetgang members.

    (a) A person commits the offense of unlawful contact with 
9
streetgang members
when:


10
        (1) He or she knowingly has direct or indirect contact 
11
    with a streetgang
member as defined in Section 10 of the 
12
    Illinois Streetgang Terrorism Omnibus
Prevention Act after 
13
    having been sentenced to probation, conditional discharge,

14
    or supervision for a criminal offense with a condition of 
15
    such sentence being
to refrain from direct or indirect 
16
    contact with a streetgang member or members;
or


17
        (2) He or she knowingly has direct or indirect contact 
18
    with a streetgang
member as defined in Section 10 of the 
19
    Illinois Streetgang Terrorism Omnibus
Prevention Act after 
20
    having been released on bond for any criminal offense with

21
    a condition of such bond being to refrain from direct or 
22
    indirect contact with
a streetgang member or members; .

        (3) He or she knowingly has direct or indirect contact 
24
    with a streetgang
member
as defined in Section 10 of the 
25
    Illinois Streetgang Terrorism Omnibus
Prevention Act
after 
26
    having been ordered by a judge in any non-criminal 
27
    proceeding to refrain
from
direct or indirect contact with 
28
    a streetgang member or members; or

29
        (4) He or she knowingly has direct or indirect contact 
30
    with a streetgang
member
as defined in Section 10 of the 
31
    Streetgang Terrorism Omnibus Prevention Act
after
having 
32
    been released from the Illinois Department of Corrections

    on a condition
of parole
or mandatory supervised release

    that he or she refrain from direct or indirect
contact with

    a streetgang member or members.

    (b) Unlawful contact with streetgang members is a Class A 
5
misdemeanor.

    (c) This Section does not apply to a person when the only 
7
streetgang member
or members he or she is with is a family or 
8
household member or members as
defined in paragraph (3) of 
9
Section 112A-3 of the Code of Criminal Procedure
of 1963 and 
10
the streetgang members are not engaged in any streetgang 
11
related
activity.
