Amends the Pharmacy Practice Act of 1987. Requires a pharmacy that dispenses medications via the Internet to Illinois residents and mails, ships, or delivers prescription medications into this State to prominently display its license or registration number at the entry point to the portion of the pharmacy's web site where prescription drugs are sold to the public. Provides that whoever dispenses medications via the Internet to Illinois residents and mails, ships, or delivers prescription medications into this State without the proper license or registration under this Act shall be guilty of a Class 4 felony for the first offense and shall be guilty of a Class 3 felony for each subsequent offense.

| AN ACT concerning pharmacies.

| Be it enacted by the People of the State of Illinois,
|
3 |
| represented in the General Assembly:
|

| Section 5. The Pharmacy Practice Act of 1987 is amended by |
5 |
| adding Section 16b as follows: |
6 |
| (225 ILCS 85/16b new) |
7 |
| Sec. 16b. Internet sales. |
8 |
| (a) A pharmacy that dispenses medications via the Internet |
9 |
| to Illinois residents and mails, ships, or delivers |
10 |
| prescription medications into this State must prominently |
11 |
| display its license or registration number at the entry point |
12 |
| to the portion of the pharmacy's web site where prescription |
13 |
| drugs are sold to the public.

| (b) Notwithstanding any other provision of this Act, |
15 |
| whoever dispenses medications via the Internet to Illinois |
16 |
| residents and mails, ships, or delivers prescription |
17 |
| medications into this State without the proper license or |
18 |
| registration under this Act shall be guilty of a Class 4 felony |
19 |
| for the first offense and shall be guilty of a Class 3 felony |
20 |
| for each subsequent offense.
