| line 4, by replacing "; and" with "; and"; and

| on page 22, line 7, by replacing "child." with "child; and ."; |

| on page 22, after line 7, by inserting the following:

| "(9) any pending criminal charge against any party to the |

| proceeding. |

| With regards to the factor set forth in item (9) of this |
| 10 |
| subsection (a), the court in its discretion may continue or |
| 11 |
| postpone a custody award until the criminal charge has been |
| 12 |
| adjudicated.".
