| AN ACT concerning counties.
|
| 2 |
| Be it enacted by the People of the State of Illinois,
|
| 3 |
| represented in the General Assembly:
|
| 4 |
| Section 5. The Counties Code is amended by changing Section |
| 5 |
| 5-12002 as follows:
|
| 6 |
| (55 ILCS 5/5-12002) (from Ch. 34, par. 5-12002)

| Sec. 5-12002. Inoperable motor vehicles. The county board |
| 8 |
| may by
ordinance declare all inoperable motor vehicles, whether |
| 9 |
| on public or
private property, to be a nuisance and authorize |
| 10 |
| fines to be levied for the
failure of any person to obey a |
| 11 |
| notice received from the county which
states that such person |
| 12 |
| is to dispose of any inoperable motor vehicles
under his or her |
| 13 |
| control. However, nothing in this Section shall apply to
any |
| 14 |
| motor vehicle that is kept within a building when not in use, |
| 15 |
| to
historic vehicles over 25 years of age, or to a motor |
| 16 |
| vehicle on the
premises of a place of business engaged in the |
| 17 |
| wrecking or junking of
motor vehicles.
|
| 18 |
| As used in this Section, "inoperable motor vehicle" means |
| 19 |
| any motor vehicle
from which, for a period of at least 6 |
| 20 |
| months, the engine, wheels or other
parts have been removed, or |
| 21 |
| on which the engine, wheels or other parts have
been altered, |
| 22 |
| damaged or otherwise so treated that the vehicle is incapable
|
| 23 |
| of being driven under its own power. "Inoperable motor vehicle" |
| 24 |
| shall not
include a motor vehicle which has been rendered |
| 25 |
| temporarily incapable of
being driven under its own motor power |
| 26 |
| in order to perform ordinary service
or repair operations.
