SYNOPSIS AS INTRODUCED:
 
20 ILCS 105/8.08 new
30 ILCS 105/5.625 new

    Amends the Illinois Act on the Aging. Requires the Director of Aging, in coordination with the Director of Public Aid and the Director of Public Health, to analyze the distribution of housing, health services, and supportive services for seniors in each geographic area of the State and to identify and designate critical access service areas. Provides that, at the end of each State fiscal year, any unspent and unencumbered General Revenue Fund appropriations for long-term care for seniors shall be deposited into the Alternative Long-Term Care Services for Seniors Fund. Provides that moneys in the Fund shall be used to fund specified alternative long-term care services with priority given to the distribution of funds for services in critical access service areas. Amends the State Finance Act to create the Alternative Long-Term Care Services for Seniors Fund as a special fund in the State treasury. Effective immediately.

1     AN ACT concerning seniors.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Act on the Aging is amended by
5 adding Section 8.08 as follows:
 
6     (20 ILCS 105/8.08 new)
7     Sec. 8.08. Critical access service areas; Alternative
8 Long-term Care Services for Seniors Fund.
9     (a) By July 1, 2005, and every 5 years thereafter, the
10 Director of Aging, in coordination with the Director of Public
11 Aid and the Director of Public Health, shall analyze the
12 distribution of housing, health services, and supportive
13 services for seniors in each geographic area of the State, with
14 particular attention to service deficits or problems, and shall
15 identify and designate critical access service areas. For the
16 purposes of this Section, "critical access service area" means
17 an area of the State that is being underserved with respect to
18 housing, health services, and supportive services, on the basis
19 of being more than 30 minutes travel time under normal driving
20 conditions from the next nearest provider or being the sole
21 provider located in an underserved area or health professional
22 shortage area.
23     (b) At the end of each State fiscal year, any unspent and
24 unencumbered General Revenue Fund appropriations for long-term
25 care for seniors, including nursing facilities, elderly
26 waivers, alternative care, and home care services, shall be
27 deposited into the Alternative Long-Term Care Services for
28 Seniors Fund, a special fund hereby created in the State
29 treasury. Moneys in the Fund, in addition to documented
30 reductions in nursing facility expenditures resulting from the
31 Nursing Facility Moratorium and Modernization Program, shall
32 be used to fund the following alternative long-term care

1 services, with priority given to the distribution of funds for
2 services in critical access service areas:
3         (1) adult day services;
4         (2) home health services;
5         (3) homemaker services;
6         (4) personal care;
7         (5) case management;
8         (6) respite care;
9         (7) services provided under the Assisted Living and
10     Shared Housing Act, sheltered care services that meet the
11     requirements of the Assisted Living and Shared Housing Act,
12     or services provided under Section 5-5.01a of the Public
13     Aid Code, the Supportive Living Facilities Pilot Program;
14         (8) emergency response services;
15         (9) transition services;
16         (10) residential care services;
17         (11) care-related supplies and equipment;
18         (12) meals delivered to the home;
19         (13) congregate meals;
20         (14) money management;
21         (15) transportation;
22         (16) companion services;
23         (17) nutrition services;
24         (18) family care services;
25         (19) training for direct informal caregivers;
26         (20) telemedicine devices to monitor recipients in
27     their own homes as an alternative to hospital care, nursing
28     home care, or home visits;
29         (21) environmental modifications; and
30         (22) other programs designed to assist older
31     Illinoisans to remain independent and receive services in
32     the most integrated setting possible for that person.
33     (d) Nothing in this Section prevents a nursing facility
34 from being eligible to provide any of the services listed in
35 subsection (c).

1     Section 10. The State Finance Act is amended by adding
2 Section 5.625 as follows:

4     Sec. 5.625. The Alternative Long-Term Care Services for
5 Seniors Fund.
 
6     Section 99. Effective date. This Act takes effect upon
7 becoming law.
