SYNOPSIS AS INTRODUCED:
 
30 ILCS 105/8.42

    Amends the State Finance Act. Transfers back or, if amounts have not yet been transferred, cancels certain interfund transfers from the Road Fund, the Motor Fuel Tax Fund, or the Grade Crossing Protection Fund to the General Revenue Fund as required under certain provisions of the State Finance Act. Effective immediately.

1     AN ACT concerning finance.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The State Finance Act is amended by changing
5 Section 8.42 as follows:
 
6     (30 ILCS 105/8.42)
7     Sec. 8.42. Interfund transfers.
8     (a) In order to address the fiscal emergency resulting from
9 shortfalls in revenue, the following transfers are authorized
10 from the designated funds into the General Revenue Fund:

12MOTOR FUEL TAX FUND...............................$1,535,000
13GRADE CROSSING PROTECTION FUND....................$6,500,000

21     All such transfers shall be made on July 1, 2003, or as
22 soon thereafter as practical. These transfers may be made
23 notwithstanding any other provision of law to the contrary.
24     (b) If any transfers from the Road Fund, the Motor Fuel Tax
25 Fund, or the Grade Crossing Protection Fund to the General
26 Revenue Fund under subsection (a) have been made, then,
27 notwithstanding any other provision of law and in addition to
28 any other transfers that may be provided for by law, on the
29 effective date of this amendatory Act of the 93rd General
30 Assembly, or as soon thereafter as practical, the State
31 Comptroller shall direct and the State Treasurer shall transfer
32 from the General Revenue Fund the amount that was transferred
33 from the Road Fund, the Motor Fuel Tax Fund, or the Grade
34 Crossing Protection Fund under subsection (a) back to that
35 dedicated fund.
36     (c) No transfer from the Road Fund, the Motor Fuel Tax

1 Fund, or the Grade Crossing Protection Fund to the General
2 Revenue Fund may be made under subsection (a) on or after the
3 effective date of this amendatory Act of the 93rd General
4 Assembly.

6     Section 99. Effective date. This Act takes effect upon
7 becoming law.
