| AN ACT in relation to criminal law.

| Be it enacted by the People of the State of Illinois, |
| 3 |
| represented in the General Assembly:
|

| Section 5. The Criminal Code of 1961 is amended by changing
|

| Section 16A-6 as follows:
|

| (720 ILCS 5/16A-6) (from Ch. 38, par. 16A-6)

| Sec. 16A-6. Affirmative defense. A detention as permitted |
| 8 |
| in this Article
does not constitute an arrest or an unlawful |
| 9 |
| restraint, as defined in Section
10-3 of this Code,
nor does

| shall it render the merchant liable to the person so detained.
