| AN ACT in relation to criminal law.

| Be it enacted by the People of the State of Illinois, |
| 3 |
| represented in the General Assembly:
|

| Section 5. The Criminal Code of 1961 is amended by changing
|

| Section 18-3 as follows:
|

| (720 ILCS 5/18-3)
|

| Sec. 18-3. Vehicular hijacking.
|
| 8 |
| (a) A person commits vehicular hijacking when he or she |
| 9 |
| takes a motor
vehicle from the person or the immediate presence |
| 10 |
| of another by the use of
force or by threatening the imminent |
| 11 |
| use of force.
|
| 12 |
| (b) For the purposes of this Article, the term "motor |
| 13 |
| vehicle" has

| (c) Sentence. Vehicular hijacking is a Class 1 felony.
