AMENDMENT TO HOUSE BILL 5633

2     AMENDMENT NO. ______. Amend House Bill 5633 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The Liquor Control Act of 1934 is amended by
5 changing Section 4-1 as follows:
 
6     (235 ILCS 5/4-1)  (from Ch. 43, par. 110)
7     Sec. 4-1. In every city, village or incorporated town, the
8 city council or president and board of trustees, and in
9 counties in respect of territory outside the limits of any such
10 city, village or incorporated town the county board shall have
11 the power by general ordinance or resolution to determine the
12 number, kind and classification of licenses, for sale at retail
13 of alcoholic liquor not inconsistent with this Act and the
14 amount of the local licensee fees to be paid for the various
15 kinds of licenses to be issued in their political subdivision,
16 except those issued to the specific non-beverage users exempt
17 from payment of license fees under Section 5-3 which shall be
18 issued without payment of any local license fees, and the
19 manner of distribution of such fees after their collection; to
20 regulate or prohibit the presence of persons under the age of
21 21 on the premises of licensed retail establishments of various
22 kinds and classifications where alcoholic liquor is drawn,
23 poured, mixed or otherwise served for consumption on the
24 premises; to prohibit any minor from drawing, pouring, or

1 mixing any alcoholic liquor as an employee of any retail
2 licensee; and to prohibit any minor from at any time attending
3 any bar and from drawing, pouring or mixing any alcoholic
4 liquor in any licensed retail premises; and to establish such
5 further regulations and restrictions upon the issuance of and
6 operations under local licenses not inconsistent with law as
7 the public good and convenience may require; and to provide
8 penalties for the violation of regulations and restrictions,
9 including those made by county boards, relative to operation
10 under local licenses; provided, however, that in the exercise
11 of any of the powers granted in this section, the issuance of
12 such licenses shall not be prohibited except for reasons
13 specifically enumerated in Sections 6-2, 6-11, 6-12 and 6-25 of
14 this Act.
15     However, in any municipality with a population exceeding
16 1,000,000 that has adopted the form of government authorized
17 under "An Act concerning cities, villages, and incorporated
18 towns, and to repeal certain Acts herein named", approved
19 August 15, 1941, as amended, no person shall be granted any
20 license or privilege to sell alcoholic liquors between the
21 hours of two o'clock a.m. and seven o'clock a.m. on week days
22 nor between the hours of three o'clock a.m. and twelve o'clock
23 noon on Sundays unless such person has given at least 14 days
24 prior written notice to the alderman of the ward in which such
25 person's licensed premises are located stating his intention to
26 make application for such license or privilege and unless
27 evidence confirming service of such written notice is included
28 in such application. Any license or privilege granted in
29 violation of this paragraph shall be null and void.
30     Notwithstanding any provision in this Section to the
31 contrary, in addition to the local liquor control commissioner,
32 the President of the Cook County Board of Commissioners may
33 authorize the sale of alcoholic liquor under a special event
34 retailer's license, for a duration not to exceed one day, on

1 property that is located within the boundaries of a
2 municipality if (1) the property is located within a forest
3 preserve district that is located within Cook County, (2) the
4 President of the Cook County Board of Commissioners notifies
5 the local liquor control commissioner of the municipality
6 within 7 days after receiving an application to sell alcoholic
7 liquor under a special event retailer's license on the property
8 that he or she has received the application, (3) the President
9 of the Cook County Board of Commissioners notifies the local
10 liquor control commissioner of the municipality of his or her
11 intent to authorize the sale of alcoholic liquor under a
12 special event retailer's license at least 14 days before
13 authorizing that sale of alcoholic liquor, and (4) the local
14 liquor control commissioner of the municipality delegates the
15 authority to issue the one-day special event retailer's license
16 to the President of the Cook County Board of Commissioners for
17 this limited purpose. If the President of the Cook County Board
18 of Commissioners authorizes the sale of alcoholic liquor under
19 a special event retailer's license, the local liquor control
20 commissioner for the territory covered by the license shall
21 have the same powers and duties under this Act as if the local
22 liquor control commissioner had authorized the sale of
23 alcoholic liquor.

25     Section 99. Effective date. This Act takes effect upon
26 becoming law.".
