| AN ACT concerning public utilities.

| Be it enacted by the People of the State of Illinois, |
| 3 |
| represented in the General Assembly:
|
| 4 |
| Section 5. The Electric Supplier Act is amended by changing |
| 5 |
| Section 3.4 as
follows:
|
| 6 |
| (220 ILCS 30/3.4) (from Ch. 111 2/3, par. 403.4)
|
| 7 |
| Sec. 3.4. Electric cooperative. "Electric Cooperative" |
| 8 |
| means (a) any
not-for-profit corporation
or other person that |
| 9 |
| owns, controls, operates or manages, directly or
indirectly, |
| 10 |
| within this State, any plant, equipment or property for the
|
| 11 |
| production, transmission, sale, delivery or furnishing of |
| 12 |
| electricity and
(b) that either is or has been financed in |
| 13 |
| whole or in part under the
federal "Rural Electrification Act |
| 14 |
| of 1936" and the Acts amendatory thereof
and supplementary |
| 15 |
| thereto, or is directly or indirectly caused to be
formed by |
| 16 |
| any one or more such not-for-profit corporations or other |
| 17 |
| persons
that is or has been so financed.
