Amends the Property Tax Code. Provides that the court shall not issue an order for tax deed to a county if: (1) a municipality has obtained a judicial deed for the property because the property has been abandoned; and (2) the municipality files an objection to the issuance of the deed to the county. Provides that, for property that meets these criteria, the court may instead issue a tax deed to the municipality, if the municipality otherwise meets the requirements for issuance of a tax deed. Effective immediately.

| AN ACT concerning taxes.

| Be it enacted by the People of the State of Illinois,
|
3 |
| represented in the General Assembly:
|

| Section 5. The Property Tax Code is amended by adding |
5 |
| Section 22-37 as follows: |
6 |
| (35 ILCS 200/22-37 new) |
7 |
| Sec. 22-37. Abandoned property in municipality; objection |
8 |
| to county obtaining deed. The court shall not issue an order |
9 |
| for tax deed to a county under Section 22-40 if: |
10 |
| (1) a municipality has obtained a judicial deed under |
11 |
| subsection (d) of Section 11-31-1 of the Illinois Municipal |
12 |
| Code for the property because the property has been |
13 |
| abandoned; and |
14 |
| (2) the municipality files an objection to the issuance |
15 |
| of the deed to the county.

| For property that meets these criteria, the court may instead |
17 |
| issue a tax deed to the municipality, if the municipality |
18 |
| otherwise meets the requirements for issuance of a tax deed.
|

| Section 99. Effective date. This Act takes effect upon |
20 |
| becoming law.
|
