| AN ACT concerning dental hygienists.
|
| 2 |
| Be it enacted by the People of the State of Illinois, |
| 3 |
| represented in the General Assembly:
|
| 4 |
| Section 5. The Illinois Dental Practice Act is amended by |
| 5 |
| changing Section 18 as follows:
|
| 6 |
| (225 ILCS 25/18) (from Ch. 111, par. 2318)

| (Section scheduled to be repealed on January 1, 2006)
|
| 8 |
| Sec. 18. Acts constituting the practice of dental hygiene; .
|
| 9 |
| limitations.
|
| 10 |
| (1)
A dental hygienist may be employed or engaged only:
|
| 11 |
| (a) Under the supervision of a dentist:
(1) in the |
| 12 |
| office of a dentist. ;
|
| 13 |
| (2) By a federal, State, county or municipal agency or |
| 14 |
| institution;
|
| 15 |
| (3) By a public or private school; or
|
| 16 |
| (4) By a public clinic operating under the direction of |
| 17 |
| a hospital or
federal, State, county, municipal or other |
| 18 |
| public agency or
institution.
|
| 19 |
| When employed or engaged pursuant to this paragraph (a) a |
| 20 |
| dental
hygienist may perform the following procedures and acts:
|
| 21 |
| (i) the operative procedure of dental hygiene, |
| 22 |
| consisting of oral
prophylactic procedures;
|
| 23 |
| (ii) the exposure and processing of X-Ray films of |
| 24 |
| the teeth and
surrounding structures;
|
| 25 |
| (iii) the application to the surfaces of the teeth |
| 26 |
| or gums of chemical
compounds designed to be |
| 27 |
| desensitizing agents or effective agents in the
|
| 28 |
| prevention of dental caries or periodontal disease;
|
| 29 |
| (iv) all services which may be performed by a
|
| 30 |
| dental assistant as specified by rule pursuant to |
| 31 |
| Section 17;
|
| 32 |
| (v) administration and monitoring of nitrous oxide |
|

| upon successful
completion of a
training program |
| 2 |
| approved by the Department;
|
| 3 |
| (vi) administration of local anesthetics upon |
| 4 |
| successful completion of
a
training program approved |
| 5 |
| by the Department; and
|
| 6 |
| (vii) such other procedures and acts as shall be |
| 7 |
| prescribed
by
rule or regulation of the Department.
|
| 8 |
| (b) Under the general supervision of a dentist (i) in |
| 9 |
| the office of a dentist, (ii) in a long-term care
facility
|
| 10 |
| licensed by the State of Illinois, (iii) in
or a mental |
| 11 |
| health or developmental
disability facility operated by |
| 12 |
| the Department of Human Services, (iv) in a public or
|
| 13 |
| private school,
(v) in a
hospital, (vi) in a prison,
(vii) |
| 14 |
| in a community health center or clinic, (viii) in a mobile |
| 15 |
| unit, or
(ix) in a home health setting if the
patient is |
| 16 |
| unable
to travel to a dental office because of illness or |
| 17 |
| infirmity. The dentist
shall personally examine and |
| 18 |
| diagnose the patient and determine which
services are |
| 19 |
| necessary to be performed, which shall be contained in a
|
| 20 |
| written order to the hygienist. Such order must be |
| 21 |
| implemented within 120 days
of its issuance, and An updated |
| 22 |
| medical history and oral inspection
must be performed by |
| 23 |
| the hygienist immediately prior to beginning the
|
| 24 |
| procedures to ensure that the patient's health has not |
| 25 |
| changed in any
manner to warrant a reexamination by the |
| 26 |
| dentist. The authorizing
dentist shall be responsible for |
| 27 |
| providing the dental examination in a
reasonable and |
| 28 |
| suitable time frame to ensure the patient's overall oral
|
| 29 |
| health.
|
| 30 |
| Before a dental hygienist may be employed or engaged under |
| 31 |
| the general
supervision of a dentist, he or she must have been |
| 32 |
| actively engaged in the
practice of dental hygiene under the |
| 33 |
| direct supervision of a dentist for a
period of at least 12 |
| 34 |
| months. A dental hygienist who provides services under
the |
| 35 |
| general supervision of a dentist must show proof of |
| 36 |
| professional liability
insurance.

| (2)
(c) Without the supervision of a dentist, a dental |
| 2 |
| hygienist may perform
dental health education functions and may |
| 3 |
| record case histories and oral
conditions observed or, in a |
| 4 |
| public health setting, as defined jointly by the Department of |
| 5 |
| Public Health and the Illinois State Board of Dentistry, |
| 6 |
| provide fluoride treatments, cleanings, and sealants for |
| 7 |
| Medicaid eligible children. |
| 8 |
| Before a dental hygienist may be employed or engaged |
| 9 |
| without the supervision of a dentist, he or she must have been |
| 10 |
| actively engaged in the practice of dental hygiene under the |
| 11 |
| direct supervision of a dentist for a period of at least 24 |
| 12 |
| months. A dental hygienist who provides services without the |
| 13 |
| supervision of a dentist must show proof of professional |
| 14 |
| liability insurance.
|
| 15 |
| (3) The number of dental hygienists practicing in a dental |
| 16 |
| office shall not
exceed, at any one time, 4 times the number of |
| 17 |
| dentists practicing in the
office at the time.
|
| 18 |
| (4) When employed or
engaged pursuant to paragraph
(a) or |
| 19 |
| (b) of subsection (1) of this Section, a dental
hygienist may |
| 20 |
| perform the following procedures and acts: |
| 21 |
| (a) the operative procedure of dental hygiene, |
| 22 |
| consisting of oral
prophylactic procedures; |
| 23 |
| (b) the exposure and processing of X-Ray films of the |
| 24 |
| teeth and
surrounding structures; |
| 25 |
| (c) the application to the surfaces of the teeth or |
| 26 |
| gums of chemical
compounds designed to be desensitizing |
| 27 |
| agents or effective agents in the
prevention of dental |
| 28 |
| caries or periodontal disease; |
| 29 |
| (d) all services which may be performed by a
dental |
| 30 |
| assistant as specified by rule pursuant to Section 17; and |
| 31 |
| (e) such other procedures and acts as shall be |
| 32 |
| prescribed
by
rule or regulation of the Department.
