The University of Illinois Act is amended by 5 adding Section 25 as follows: 6 (110 ILCS 305/25 new) 7 Sec. 25. Full-time position requirements. 8 (a) In order to enhance the quality of university 9 instruction and provide for more equitable treatment of 10 university faculty members, it shall be the policy of the 11 State of Illinois that part-time teachers (i) be used solely 12 to supplement and not to replace any existing full-time 13 tenured or nontenured faculty member and (ii) be used solely 14 in those instances in which a full-time position cannot be 15 generated or when specialized services that no full-time 16 tenured or nontenured faculty member is competent to render 17 are required. 18 (b) The Board of Trustees shall achieve, on a phased-in 19 basis as provided in this subsection (b), a ratio between its 20 full-time faculty members and part-time teachers under which 21 at least 75% of all full-time equivalent teaching positions 22 at the University are held by full-time faculty members and 23 not more than 25% of all full-time equivalent teaching 24 positions at the University are held by part-time teachers; 25 provided that this subsection (b) shall not be construed to 26 prohibit job sharing of full-time positions. 27 Beginning with fiscal year 2004, and in each fiscal year 28 thereafter, the University shall use and apply not less than 29 33% of the amount by which aggregate State funds received by 30 the University for the current fiscal year exceed aggregate 31 State funds received by the University for the immediately -2- LRB093 06093 NHT 06198 b 1 preceding fiscal year, if there is an increase, to (i) 2 increase the number of full-time equivalent teaching 3 positions at the University that are held by full-time 4 faculty members and (ii) decrease the number of full-time 5 equivalent teaching positions at the University that are held 6 by part-time teachers. The requirement of using a specified 7 percentage of each fiscal year's increase, if any, in 8 aggregate State funds received by the University shall no 9 longer apply to the University when at least 75% of full-time 10 equivalent teaching positions at the University are held by 11 full-time faculty members and not more than 25% of full-time 12 equivalent teaching positions at the University are held by 13 part-time teachers. 14 (c) The Board of Higher Education shall adopt all rules 15 necessary to implement and administer this Section. 16 Section 10. The Southern Illinois University Management 17 Act is amended by adding Section 15 as follows: 18 (110 ILCS 520/15 new) 19 Sec. 15. Full-time position requirements. 20 (a) In order to enhance the quality of university 21 instruction and provide for more equitable treatment of 22 university faculty members, it shall be the policy of the 23 State of Illinois that part-time teachers (i) be used solely 24 to supplement and not to replace any existing full-time 25 tenured or nontenured faculty member and (ii) be used solely 26 in those instances in which a full-time position cannot be 27 generated or when specialized services that no full-time 28 tenured or nontenured faculty member is competent to render 29 are required. 30 (b) The Board shall achieve, on a phased-in basis as 31 provided in this subsection (b), a ratio between its 32 full-time faculty members and part-time teachers under which -3- LRB093 06093 NHT 06198 b 1 at least 75% of all full-time equivalent teaching positions 2 at the University are held by full-time faculty members and 3 not more than 25% of all full-time equivalent teaching 4 positions at the University are held by part-time teachers; 5 provided that this subsection (b) shall not be construed to 6 prohibit job sharing of full-time positions. 7 Beginning with fiscal year 2004, and in each fiscal year 8 thereafter, the University shall use and apply not less than 9 33% of the amount by which aggregate State funds received by 10 the University for the current fiscal year exceed aggregate 11 State funds received by the University for the immediately 12 preceding fiscal year, if there is an increase, to (i) 13 increase the number of full-time equivalent teaching 14 positions at the University that are held by full-time 15 faculty members and (ii) decrease the number of full-time 16 equivalent teaching positions at the University that are held 17 by part-time teachers. The Chicago State University Law is amended 28 by adding Section 5-120 as follows: 29 (110 ILCS 660/5-120 new) 30 Sec. 5-120. The Governors State University Law is 16 amended by adding Section 15-120 as follows: 17 (110 ILCS 670/15-120 new) 18 Sec. 15-120. The Illinois State University Law is amended 27 by adding Section 20-125 as follows: 28 (110 ILCS 675/20-125 new) 29 Sec. 20-125. The Northeastern Illinois University Law is 4 amended by adding Section 25-120 as follows: 5 (110 ILCS 680/25-120 new) 6 Sec. 25-120. The Northern Illinois University Law is 15 amended by adding Section 30-130 as follows: 16 (110 ILCS 685/30-130 new) 17 Sec. 30-130. The Western Illinois University Law is 26 amended by adding Section 35-125 as follows: 27 (110 ILCS 690/35-125 new) 28 Sec. 35-125. Full-time position requirements. 29 (a) In order to enhance the quality of university 30 instruction and provide for more equitable treatment of 31 university faculty members, it shall be the policy of the 32 State of Illinois that part-time teachers (i) be used solely -12- LRB093 06093 NHT 06198 b 1 to supplement and not to replace any existing full-time 2 tenured or nontenured faculty member and (ii) be used solely 3 in those instances in which a full-time position cannot be 4 generated or when specialized services that no full-time 5 tenured or nontenured faculty member is competent to render 6 are required. 7 (b) The Board shall achieve, on a phased-in basis as 8 provided in this subsection (b), a ratio between its 9 full-time faculty members and part-time teachers under which 10 at least 75% of all full-time equivalent teaching positions 11 at the University are held by full-time faculty members and 12 not more than 25% of all full-time equivalent teaching 13 positions at the University are held by part-time teachers; 14 provided that this subsection (b) shall not be construed to 15 prohibit job sharing of full-time positions. 16 Beginning with fiscal year 2004, and in each fiscal year 17 thereafter, the University shall use and apply not less than 18 33% of the amount by which aggregate State funds received by 19 the University for the current fiscal year exceed aggregate 20 State funds received by the University for the immediately 21 preceding fiscal year, if there is an increase, to (i) 22 increase the number of full-time equivalent teaching 23 positions at the University that are held by full-time 24 faculty members and (ii) decrease the number of full-time 25 equivalent teaching positions at the University that are held 26 by part-time teachers. The requirement of using a specified 27 percentage of each fiscal year's increase, if any, in 28 aggregate State funds received by the University shall no 29 longer apply to the University when at least 75% of full-time 30 equivalent teaching positions at the University are held by 31 full-time faculty members and not more than 25% of full-time 32 equivalent teaching positions at the University are held by 33 part-time teachers. 34 (c) The Board of Higher Education shall adopt all rules -13- LRB093 06093 NHT 06198 b 1 necessary to implement and administer this Section. 2 Section 50. The Public Community College Act is amended 3 by adding Section 3-26.2 as follows: 4 (110 ILCS 805/3-26.2 new) 5 Sec. 3-26.2. Full-time position requirements. 6 (a) In order to enhance the quality of community college 7 instruction and provide for more equitable treatment of 8 community college faculty members, it shall be the policy of 9 the State of Illinois that part-time teachers be used solely 10 to supplement and not to replace any existing full-time 11 tenured or nontenured faculty member. 12 (b) Each community college board shall achieve, on a 13 phased-in basis as provided in this subsection (b), a ratio 14 between its full-time faculty members and part-time teachers 15 under which at least 75% of all full-time equivalent teaching 16 positions in the community college district are held by 17 full-time faculty members and not more than 25% of all 18 full-time equivalent teaching positions in the community 19 college district are held by part-time teachers; provided 20 that this subsection (b) shall not be construed to prohibit 21 job sharing of full-time positions. 22 Beginning with fiscal year 2004, and in each fiscal year 23 thereafter, a community college district shall use and apply 24 not less than 33% of the amount by which aggregate grants 25 received by the district under Section 2-16.02 for the 26 current fiscal year exceed aggregate grants received by the 27 district under that Section for the immediately preceding 28 fiscal year, if there is an increase, to (i) increase the 29 number of full-time equivalent teaching positions in the 30 district that are held by full-time faculty members and (ii) 31 decrease the number of full-time equivalent teaching 32 positions in the district that are held by part-time -14- LRB093 06093 NHT 06198 b 1 teachers. The requirement of using a specified percentage of 2 each fiscal year's increase, if any, in aggregate grants 3 received by the district under Section 2-16.02 shall no 4 longer apply to the district when at least 75% of full-time 5 equivalent teaching positions in the district are held by 6 full-time faculty members and not more than 25% of full-time 7 equivalent teaching positions in the district are held by 8 part-time teachers. 9 (c) The State Board shall adopt all rules necessary to 10 implement and administer this Section. 11 Section 99. Effective date. This Act takes effect upon 12 becoming law.
