| AMENDMENT TO SENATE BILL 1005

| AMENDMENT NO. ______. Amend Senate Bill 1005 by replacing |

| everything after the enacting clause with the following:

| "Section 5. The Environmental Protection Act is amended by |
| 5 |
| adding Section 10.1 as follows:

| (415 ILCS 5/10.1 new) |
| 7 |
| Sec. 10.1. Ordinance required. Notwithstanding any other |
| 8 |
| provision of this Act, any municipality with a population |
| 9 |
| between 4,000 and 6,000 located in a county with a population |
| 10 |
| over 5,000,000 must adopt an ordinance prohibiting all burning |
| 11 |
| of landscape waste by January 1, 2005. This Section is repealed |
| 12 |
| January 1, 2008.

| Section 99. Effective date. This Act takes effect upon |
| 14 |
| becoming law.".
