093_SB1069eng SB1069 Engrossed LRB093 10917 BDD 11447 b 1 AN ACT concerning finance. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 3. The Military Code of Illinois is amended by 5 changing Section 22-9 as follows: 6 (20 ILCS 1805/22-9) 7 Sec. 22-9. Power to make grants from the Illinois 8 Military Family Relief Fund.Subject to appropriation,The 9 Department of Military Affairs shall have the power to make 10 grants from the Illinois Military Family Relief Fund, a 11 special fund created in the State treasury, to families of 12 persons who are members of the Illinois National Guard or 13 Illinois residents who are members of the reserves of the 14 armed forces of the United States and who have been called to 15 active duty as a result of the September 11, 2001 terrorist 16 attacks. The Department of Military Affairs shall establish 17 eligibility criteria for the grants by rule. 18 In addition to amounts transferred into the Fund under 19 Section 510 of the Illinois Income Tax Act, the State 20 Treasurer shall accept and deposit into the Fund all gifts, 21 grants, transfers, appropriations, and other amounts from any 22 legal source, public or private, that are designated for 23 deposit into the Fund. 24 This Section constitutes an irrevocable and continuing 25 appropriation of all amounts transferred under Section 8h of 26 the State Finance Act and all amounts derived from gifts and 27 grants, including, without limitation, amounts from all 28 private sources, in the Fund to the Department of Military 29 Affairs for the purpose of making grants under this Section. 30 All other amounts in the Fund are subject to appropriation by 31 the General Assembly. Transfers between the Communications Revolving 6 Fund and the Illinois Military Family Relief Fund. The State 7 Comptroller shall order transferred and the Treasurer shall 8 transfer, on March 31, 2003 or as soon as practicable 9 thereafter, the amount of $300,000 from the Communications 10 Revolving Fund to the Illinois Military Family Relief Fund. 11 Beginning on July 1, 2004, the State Comptroller shall order 12 transferred and the Treasurer shall transfer, on the last day 13 of each month, an amount equal to 50% of that day's beginning 14 balance in the Illinois Military Family Relief Fund from the 15 Illinois Military Family Relief Fund to the Communications 16 Revolving Fund. These transfers shall continue until the 17 cumulative total of transfers executed from the Illinois 18 Military Family Relief Fund to the Communications Revolving 19 Fund equals $300,000. 20 Section 99. Effective date. This Act takes effect upon 21 becoming law.
