093_SB1109 LRB093 06745 DRJ 06880 b 1 AN ACT in relation to public aid. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Illinois Public Aid Code is amended by 5 changing Section 5-4.1 as follows: 6 (305 ILCS 5/5-4.1) (from Ch. 23, par. 5-4.1) 7 Sec. 5-4.1. Co-payments. The Department may by rule 8 provide that recipients under any Article of this Code shall 9 pay a fee as a co-payment for services. Co-payments may not 10 exceed$3 for brand name drugs,$1 forotherpharmacy 11 services other than prescription drugs,and $2 for 12 physicians services, dental services, optical services and 13 supplies, chiropractic services, podiatry services, and 14 encounter rate clinic services. Co-payments may not exceed 15 $3 for hospital outpatient and clinic services. Provided, 16 however, that any such rule must provide that no co-payment 17 requirement can exist (i) for prescription drugs, (ii) for 18 renal dialysis, radiation therapy, cancer chemotherapy, or 19 insulin, and other products necessary on a recurring basis, 20 the absence of which would be life threatening, (iii)or21 where co-payment expenditures for required services and/or 22 medications for chronic diseases that the Illinois Department 23 shall by rule designate shall cause an extensive financial 24 burden on the recipient, or (iv)and provided no co-payment25shall existfor emergency room encounters which are for 26 medical emergencies. 27 (Source: P.A. 92-597, eff. 6-28-02.) 28 Section 99. Effective date. This Act takes effect upon 29 becoming law.
