 1        AN ACT concerning insurance.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section  5.  The  Illinois  Insurance  Code is amended by
 5    adding Section 368d as follows:

 6        (215 ILCS 5/368d new)
 7        Sec. 368d. Fairness in contracting procedures.
 8        (a)  A health care professional or health  care  provider
 9    shall  be  provided  with  a  complete  copy  of any proposed
10    professional  services  contract  including  access  to   all
11    required  or  referenced  policies, protocols, or procedures.
12    The health care professional or health care provider shall be
13    allowed at least 30 days  to  review  the  complete  contract
14    before being required to sign the contract.
15        (b)  A  health  care professional or health care provider
16    shall be provided written notice  of  any  proposed  material
17    changes  to  the contract or its administrative policies. The
18    professional or provider shall be given  the  opportunity  to
19    terminate  the  contract  prior  to the effective date of the
20    proposed change. At least 90  days  notice  of  any  proposed
21    change shall be provided.

22        Section.  99.  Effective  date.  This Act takes effect on
23    December 1, 2003.
