SYNOPSIS AS INTRODUCED:
 
70 ILCS 920/3   from Ch. 23, par. 1703

    Amends the Tuberculosis Sanitarium District Act. Provides that, for tuberculosis sanitarium districts in counties with a population of 2,000,000 or more, the county board may expand the board to 9 members if (i) the county board, by majority vote, adopts a resolution to expand the board to 9 members and (ii) the county board transmits a copy to the tuberculosis sanitarium district board along with the names of the new members. Provides that each of the additional members shall be appointed for a term of 3 years and the appointments shall be made within 60 days of adoption of the resolution. Provides that the additional members may be members of the same political party. Effective immediately.

1     AN ACT concerning tuberculosis sanitarium districts.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Tuberculosis Sanitarium District Act is
5 amended by changing Section 3 as follows:
 
6     (70 ILCS 920/3)  (from Ch. 23, par. 1703)
7     Sec. 3. All courts shall take judicial notice of all
8 tuberculosis sanitarium districts organized under this Act.
9 The affairs of such district shall be managed by a board of 3
10 directors, appointed by the presiding officer of the county
11 board with the advice and consent of the county board, of the
12 county in which the district is situated, except that in
13 districts of 500,000 or more population the board of directors
14 shall consist of 5 members. At least one member of the board of
15 directors shall be a licensed physician, and all shall be
16 chosen with reference to their special fitness for the office.
17 The first appointments shall be made within 90 days and not
18 sooner than 60 days after the district has been organized as
19 provided herein. Each member of the board shall be a legal
20 voter in the district. At the time of the making of the first
21 appointments, one director shall be appointed for a term of one
22 year, one for a term of 2 years, and one for 3, as the case may
23 be, for a term of 3 years, and until their successors are
24 appointed and qualified. At the expiration of the term of any
25 member, his successor shall be appointed in like manner for a
26 term of 3 years and until his successor is appointed and
27 qualified. But no more than 2 members of such board, if it
28 shall be a board of 3 members, and no more than 3 members of
29 such board, if it shall be a board of 5 members, shall be of the
30 same political party. Each member of the board before entering
31 upon the duties of his office shall take the oath prescribed by
32 the Constitution.

1     From the time of the appointment of the first board of
2 directors, such district shall be a body corporate and politic
3 by the name and style determined as aforesaid, and by such name
4 may sue and be sued, contract and be contracted with, acquire
5 and hold real and personal estate necessary for the corporate
6 purposes and adopt a seal and alter the same at its pleasure.
7     For districts in counties with a population of 2,000,000 or
8 more, the county board may expand the tuberculosis sanitarium
9 district board to 9 members if (i) the county board, by
10 majority vote, adopts a resolution to expand the tuberculosis
11 sanitarium district board to 9 members and (ii) the county
12 board transmits a copy to the tuberculosis sanitarium district
13 board along with the names of the new members. Each of the
14 additional members shall be appointed for a term of 3 years.
15 The appointment of the additional members shall be made within
16 60 days after the county board adopts the resolution expanding
17 the tuberculosis sanitarium district board to 9 members. The
18 additional members may be members of the same political party.
