| AMENDMENT NO. ______. Amend Senate Bill 2768 by replacing |

| lines 25 through 34 on page 2 and lines 1 through 30 on page 3 |

| with the following:

| "Section 10. The Hospital Licensing Act is amended by |
| 6 |
| adding Section 6.22 as follows: |
| 7 |
| (210 ILCS 85/6.22 new) |
| 8 |
| Sec. 6.22. Vaccinations. |
| 9 |
| (a) Subject to the availability of vaccine supplies, |
| 10 |
| patients age 65 or over who are admitted
between November
30 |
| 11 |
| and April 1 shall, as medically
appropriate,
receive an |
| 12 |
| influenza vaccination prior to or as part of the discharge |
| 13 |
| planning process, unless the
vaccine is
medically
|
| 14 |
| contraindicated or the patient has refused the vaccine. In the |
| 15 |
| event that the
Advisory
Committee on Immunization Practices of |
| 16 |
| the Centers for Disease Control and
Prevention determines that |
| 17 |
| dates of administration other than those stated in
this Section |
| 18 |
| are optimal to
protect the health of patients, the Department |
| 19 |
| is authorized to develop rules
to mandate
vaccinations at those |
| 20 |
| times rather than the times stated in this Section. A
hospital |
| 21 |
| shall
document in the patient's medical record that an annual |
| 22 |
| vaccination against
influenza
was administered, refused, or |
| 23 |
| medically contraindicated. |
