| AN ACT concerning criminal law.
|

| Be it enacted by the People of the State of Illinois,
|
| 3 |
| represented in the General Assembly:
|
| 4 |
| Section 5. The Code of Criminal Procedure of 1963 is |
| 5 |
| amended by adding Section 103-10 as follows: |
| 6 |
| (725 ILCS 5/103-10 new) |
| 7 |
| Sec. 103-10. Law enforcement agencies; use of video cameras |
| 8 |
| to enforce criminal laws or ordinances prohibited. |
| 9 |
| (a) A law enforcement agency or law enforcement officer may |
| 10 |
| not use a video camera or recording device, openly placed, that |
| 11 |
| displays an oscillating, rotating, or flashing light as |
| 12 |
| described in Section 12-215 of the Illinois Vehicle Code to |
| 13 |
| record visual images of public streets or highways and |
| 14 |
| pedestrians or motor vehicle drivers on those streets or |
| 15 |
| highways for the purpose of enforcing the criminal laws of this |
| 16 |
| State or the criminal ordinances of a unit of local government. |
| 17 |
| (b) Video camera images recorded in violation of subsection |
| 18 |
| (a) are inadmissible in any criminal proceeding as evidence |
| 19 |
| against a pedestrian or driver shown in those images and may |
| 20 |
| not be used as a basis for an arrest of any person shown in |
| 21 |
| those images to be violating the criminal laws of this State or |
| 22 |
| the criminal ordinances of a unit of local government. |
| 23 |
| (c) This Section does not prohibit: |
| 24 |
| (1) a law enforcement agency or law enforcement officer |
| 25 |
| from placing a video camera or recording device, secretly |
| 26 |
| or openly placed, for the purpose of enforcing the Illinois |
| 27 |
| Vehicle Code or similar ordinances of a unit of local |
| 28 |
| government that regulate the moving of traffic; |
| 29 |
| (2) the placing of a video camera or recording device |
| 30 |
| in or on a police vehicle; or |
| 31 |
| (3) the use of an eavesdropping device for undercover |
| 32 |
| law enforcement purposes as authorized under Section 14-3 |
