| AMENDMENT TO SENATE BILL 2806

| AMENDMENT NO. ______. Amend Senate Bill 2806 by replacing |

| everything after the enacting clause with the following:

| "Section 5. The Consumer Fraud and Deceptive Business |
| 5 |
| Practices Act is
amended by adding Section 2QQ as follows:

| (815 ILCS 505/2QQ new)
|
| 7 |
| Sec. 2QQ. Public Utilities Act; elderly persons or disabled
|
| 8 |
| persons;
penalties. It is an unlawful practice within the |
| 9 |
| meaning of this Act to commit a violation punishable under |
| 10 |
| Section 5-202 of the Public Utilities Act that results in an |
| 11 |
| actual injury or loss to an elderly person or disabled person. |
| 12 |
| A civil penalty of $25,000 may be imposed for each violation of |
| 13 |
| this Section and shall be paid into the Community Senior |
| 14 |
| Services and Resources Fund. |
| 15 |
| For the purposes of this Section: |
| 16 |
| "Elderly person" means a person 60 years of age or older. |
| 17 |
| "Disabled person" has the meaning ascribed to "person with |
| 18 |
| a disability" in Section 16-1.3 of the Criminal Code of 1961.

| 19 |
| Section 99. Effective date. This Act takes effect upon |
| 20 |
| becoming law.".
