Amends the Medical Practice Act of 1987. Provides that, subject to appropriation, the Department of Professional Regulation shall create a program for the State fiscal year beginning July 1, 2004 to reimburse physicians licensed under the Act in specific high-risk specialties for a portion of their medical malpractice premiums. Effective July 1, 2004.

| AN ACT concerning physicians.
|

| Be it enacted by the People of the State of Illinois,
|
| 3 |
| represented in the General Assembly:
|
| 4 |
| Section 5. The Medical Practice Act of 1987 is amended by |
| 5 |
| adding Section 28.5 as follows: |
| 6 |
| (225 ILCS 60/28.5 new) |

| (Section scheduled to be repealed on January 1, 2007) |
| 8 |
| Sec. 28.5. Medical malpractice premium reimbursement |
| 9 |
| program.
|
| 10 |
| (a) Subject to appropriation, the Department shall create a |
| 11 |
| program for the State fiscal year beginning July 1, 2004 to |
| 12 |
| reimburse physicians licensed under this Act in specific |
| 13 |
| high-risk specialties for a portion of their medical |
| 14 |
| malpractice premiums. |
| 15 |
| (b) The Department shall reimburse any physician eligible |
| 16 |
| for the program under this Section for up to 75% of their |
| 17 |
| premium increase based on the insurance premium invoices |
| 18 |
| required under subsection (c) with a maximum reimbursement of |
| 19 |
| $100,000 per physician. For the purposes of this subsection, |
| 20 |
| "premium increase" does not include changes in coverage, |
| 21 |
| including coverage limits, new procedures, or increased risk.

| 22 |
| (c) To participate in the program, physicians must apply to |
| 23 |
| the Department on forms approved by the Department and submit |
| 24 |
| insurance premium invoices showing premiums due between July 1, |
| 25 |
| 2003 and June 30, 2004 and between July 1, 2004 and June 30, |
| 26 |
| 2005.

| (d) Physicians who specialize in the following areas are |
| 28 |
| eligible to participate in the program established under this |
| 29 |
| Section: |
| 30 |
| (1) Obstetrics. |
| 31 |
| (2) Emergency medicine. |
| 32 |
| (3) Neonatology. |
