AMENDMENT TO HOUSE BILL 27

    AMENDMENT NO. ______. Amend House Bill 27  by replacing

everything after the enacting clause with the following:

    "Section 5. The Counties Code is amended by adding Section 
5
5-1127 as follows:

    (55 ILCS 5/5-1127 new)

    Sec. 5-1127. Regulation and licensure; adult entertainment 
8
facility.

    (a) The county board of a county having a population of 
10
less than 750,000 may license or regulate any business (i) that 
11
is operating
as an adult entertainment facility; (ii) that is 
12
located in an unincorporated area of the
county; (iii)  that 
13
permits the consumption of alcoholic
liquor on the business 
14
premises; and (iv) that is not licensed under the Liquor

15
Control Act of 1934.

    (b) For purposes of this Section, "adult entertainment 
17
facility" means that term as it is defined in Section 5-1097.5.

    Section 10. The Illinois Municipal Code is amended by 
19
adding Section
11-42-10.2 as follows:

    (65 ILCS 5/11-42-10.2 new)

    Sec. 11-42-10.2. Regulation and licensure; adult 
22
entertainment facility.

    (a) The corporate authorities of each municipality having a 
2
population of less than 750,000 may
license or regulate any 
3
business (i) that is operating
as an adult entertainment 
4
facility; (ii) that permits the consumption of alcoholic
liquor 
5
on the business premises; and (iii) that is not
licensed under 
6
the Liquor Control Act of 1934.

    (b) For purposes of this Section, "adult entertainment 
8
facility" means that term as it is defined in Section 11-5-1.5.

    Section 99. Effective date. This Act takes effect upon 
10
becoming law.".
