    AMENDMENT NO. ______. Amend House Bill 27, AS AMENDED, by

replacing everything after the enacting clause with the

following:

    "Section 5. The Counties Code is amended by changing 
6
Section 5-1049.1 as follows:

    (55 ILCS 5/5-1049.1)  (from Ch. 34, par. 5-1049.1)

    Sec. 5-1049.1. Lease of public lands. The county board may 
9
enter into
agreements to lease lands owned by the county for $1 
10
per year if the county
board determines that the lease will 
11
serve public health purposes or public safety purposes as 
12
described by subsection (j) of Section 10 of the Illinois 
13
Emergency Management Agency Act.

    Section 10. The Illinois Municipal Code is amended by

adding Section
11-42-10.2 as follows:

    (65 ILCS 5/11-42-10.2 new)

    Sec. 11-42-10.2. Regulation and licensure; adult

entertainment facility.

    (a) The corporate authorities of each municipality having a 
21
population of less than 750,000 may
license or regulate any 
22
business (i) that is operating
as an adult entertainment

facility; (ii) that permits the consumption of alcoholic
liquor 
2
on the business premises; and (iii) that is not
licensed under 
3
the Liquor Control Act of 1934.

    (b) For purposes of this Section, "adult entertainment 
5
facility" means that term as it is defined in Section 11-5-1.5.

    Section 99. Effective date. This Act takes effect upon 
7
becoming law.".
