| AN ACT in relation to transportation.
|

| Be it enacted by the People of the State of Illinois, |
3 |
| represented in the General Assembly:
|

| Section 5. The Illinois Vehicle Code is amended by adding |
5 |
| Section 11-1427.5
as follows:
|

| (625 ILCS 5/11-1427.5 new)
|

| Sec. 11-1427.5. All-terrain vehicles; persons under the |
8 |
| age
of 18. A person under the age of 18 years may not operate or |
9 |
| ride as a passenger on an all-terrain
vehicle unless he or she |
10 |
| is wearing a protective helmet. |
11 |
| Section 10. The Snowmobile Registration and Safety Act is |
12 |
| amended by changing Section 5-3 as follows:
|

| Sec. 5-3. Youthful operators and passengers
Operators .
|
15 |
| A. No person under 10 years of age may operate a |
16 |
| snowmobile, other than
machines designed for use by small |
17 |
| children primarily as a toy and
used only on private property |
18 |
| and not on any public use trail.
|
19 |
| B. Persons at least 10 and less than 12 years of age may |
20 |
| operate a
snowmobile only if they are either accompanied on the |
21 |
| snowmobile
by a parent or guardian or a person at least 18 |
22 |
| years of age
designated by a parent or guardian.
|
23 |
| C. Persons at least 12 and less than
16 years of age may |
24 |
| operate a snowmobile only if they are either accompanied
on the |
25 |
| snowmobile by a parent or guardian or a person at least 16 |
26 |
| years of
age designated by a parent or guardian, or such |
27 |
| operator is in possession of a
certificate issued by the |
28 |
| Department authorizing the holder to operate
snowmobiles.

| C-1. A person under the age of 18 years may not operate or |

| ride as a passenger on a snowmobile unless he or she is wearing |

| a protective helmet.
|

| D. Any person who operates a snowmobile on a highway as |
3 |
| provided in
Section 5-2 shall (1) possess a valid motor vehicle |
4 |
| driver's license; or
(2) possess a safety certificate as |
5 |
| provided for in this Section. Any such
person less than 16 |
6 |
| years of age shall also be under the immediate
supervision of a |
7 |
| parent or guardian or a person at least 18 years of age
|
8 |
| designated by the parent or guardian.
|
9 |
| E. Violations of this Section done with the knowledge of a
|
10 |
| parent or guardian shall be deemed a violation by the parent
or |
11 |
| guardian and punishable under Article X of this Act.
|
12 |
| F. The department shall establish a program of instruction |
13 |
| on
snowmobile laws, regulations, safety and related subjects.
|
14 |
| It is unlawful for any person under 16 years of age to
operate |
15 |
| a snowmobile on a public highway in this State. The program
|
16 |
| shall be conducted by instructors certified by the department. |
17 |
| The
department may procure liability insurance coverage for |
18 |
| certified
instructors for work within the scope of their duties |
19 |
| under this section.
Persons satisfactorily completing this |
20 |
| program shall receive certification
from the department. The |
21 |
| department may charge each person who enrolls
in the course an |
22 |
| instruction fee of $2.50. If a fee is authorized by
the |
23 |
| department, the department shall authorize instructors |
24 |
| conducting such
courses meeting standards established by it to |
25 |
| retain $1 of the fee to
defray expenses incurred locally to |
26 |
| operate the program. The
remaining $1.50 of the fee shall be |
27 |
| retained by the department to
defray a part of its expenses |
28 |
| incurred to operate the safety and
accident reporting program. |
29 |
| A person over the age of 12 years but
under the age of 16 years |
30 |
| who holds a valid certificate issued by
another state or |
31 |
| province of the Dominion of Canada need not obtain
a |
32 |
| certificate from the department if the course content of the |
33 |
| program
in such other state or province substantially meets |
34 |
| that established
by the department under this section. A |
35 |
| certificate issued by the
Department, or by another State or a |
36 |
| province of the Dominion of Canada,
shall not constitute a |
