    Amends the School Code.  Provides that teachers and other school employees are required to work on certain legal school holidays, provided that appropriate instruction is given to students on that day or that day is used for other activities, including without limitation teachers' institutes or parent-teacher conferences. Makes technical changes.

    AN ACT concerning education.

    Be it enacted by the People of the State of Illinois,
 
3
represented in the General Assembly:

    Section 5. The School Code is amended  by changing Section 
5
24-2 as follows:

    (105 ILCS 5/24-2)  (from Ch. 122, par. 24-2)

    Sec. 24-2. Holidays. Teachers shall not be required
to 
8
teach on Saturdays; nor shall teachers or other school

9
employees, other than noncertificated school employees whose 
10
presence is
necessary because of an emergency or for the 
11
continued operation and
maintenance of school facilities or 
12
property, be
required to work on legal school
holidays, which 
13
are January 1, New Year's Day; the third Monday in
January, the 
14
birthday
Birthday of Dr. Martin Luther King, Jr.; February 12, 
15
the
birthday
Birthday of President Abraham Lincoln; the
first 
16
Monday in March (to be known as Casimir Pulaski's birthday); 
17
Good
Friday; the day designated as Memorial Day by federal law; 
18
July 4,
Independence Day; the first Monday in September, Labor 
19
Day; the second Monday
in October, Columbus Day; November 11, 
20
Veterans'
Veteran's Day; the Thursday in
November commonly 
21
called Thanksgiving Day; and December 25, Christmas Day, except 
22
that teachers and other school employees may be required to 
23
work on the third Monday in January, February 12, the first 
24
Monday in March, the second Monday in October, or November 11, 
25
provided that appropriate instruction is given to students on 
26
that day or that day is used for other activities, including 
27
without limitation teachers' institutes or parent-teacher 
28
conferences.
School boards may grant special holidays whenever 
29
in their judgment such
action is advisable, except that no 
30
school board or board of education
may
designate or observe as 
31
a special holiday on which teachers or
other school
employees 
32
are not required to work the days on which general elections

members of the Illinois House of Representatives are held.

No deduction shall
be made from the time or
compensation of a 
3
school employee on account of any legal
or special holiday.

    Commemorative holidays, which recognize specified 
5
patriotic, civic,
cultural or historical persons, activities, 
6
or events, are regular school
days. Commemorative
holidays are: 
7
January 28 (to be known as Christa McAuliffe Day and
observed 
8
as a commemoration of space exploration), February 15 (the

9
birthday of Susan B. Anthony), March 29 (Viet Nam War Veterans'

10
Veterans Day),
September 11 (September 11th Day of 
11
Remembrance), the school day
immediately preceding Veterans'

12
Veteran's Day (Korean War Veterans'
Veterans
Day), October 1 
13
(Recycling Day), December 7 (Pearl Harbor Veterans'
Veterans 
14
Day) and
any day so appointed by the President or
Governor.  
15
School boards may establish commemorative holidays whenever in

16
their judgment such action is advisable.
School boards shall 
17
include instruction relative to commemorated persons,

18
activities, or
events on the commemorative holiday or at any 
19
other time during the school
year and at any point in the 
20
curriculum when such instruction may be deemed
appropriate. The 
21
State Board of Education shall prepare and make available
to 
22
school boards instructional materials relative to commemorated 
23
persons,
activities,
or events which may be used by school 
24
boards in conjunction with any
instruction provided pursuant to 
25
this paragraph.

    City of Chicago School District 299 shall observe March 4 
27
of each year as
a commemorative holiday.  This holiday shall be 
28
known as Mayors' Day which
shall be a day to commemorate and be 
29
reminded of the past Chief Executive
Officers of the City of 
30
Chicago, and in particular the late Mayor Richard
J. Daley and 
31
the late Mayor Harold Washington.  If March 4 falls on a

32
Saturday or Sunday, Mayors' Day shall be observed on the 
33
following Monday.
