Creates the Public Health Program Beneficiary Employer Disclosure Act. Provides that an applicant for benefits under Medicaid or the Children's Health Insurance Program, or a person requesting uncompensated care in a hospital, must identify the employer or employers of the proposed beneficiary of the health care benefits provided under that program. Requires the Department of Public Aid to submit to the General Assembly an annual report, beginning in 2007, identifying all such identified employers who employ 25 or more public health program beneficiaries. Provides for public access to the report.

| AN ACT concerning health.
|

| Be it enacted by the People of the State of Illinois,
|
3 |
| represented in the General Assembly:
|

| Section 1. Short title. This Act may be cited as the Public |
5 |
| Health Program Beneficiary Employer Disclosure Act. |
6 |
| Section 5. Definition. In this Act, "public health program" |
7 |
| means either of the following: |
8 |
| (1) The medical assistance program under Article V of |
9 |
| the Illinois Public Aid Code. |
10 |
| (2) The children's health insurance program under the |
11 |
| Children's Health Insurance Program Act. |
12 |
| Section 10. Disclosure of employer required. An applicant |
13 |
| for health care benefits under a public health program, or a |
14 |
| person requesting uncompensated care in a hospital, must |
15 |
| identify the employer or employers of the proposed beneficiary |
16 |
| of the health care benefits. If the proposed public health |
17 |
| program beneficiary is not employed, the applicant must |
18 |
| identify the employer or employers of any adult who is |
19 |
| responsible for providing all or some of the proposed |
20 |
| beneficiary's support. |

| Section 15. Reporting of disclosed information. |
22 |
| (a) On or before March 1 of each year, beginning in 2007, |
23 |
| the Department of Public Aid shall submit to the General |
24 |
| Assembly a report identifying all employers identified under |
25 |
| Section 10 who employ 25 or more public health program |
26 |
| beneficiaries. In determining whether the 25-employee |
27 |
| threshold is met, the Department shall include all public |
28 |
| health program beneficiaries employed by the employer and its |
29 |
| subsidiaries at all locations within the State. The report |
30 |
| shall include (i) each employer's name (and, as appropriate, |
