| AMENDMENT TO HOUSE BILL 1318

| AMENDMENT NO. ______. Amend House Bill 1318 by replacing |

| everything after the enacting clause with the following:

| "Section 5. The Good Samaritan Act is amended by adding |

| Section 72 as follows:

| (745 ILCS 49/72 new) |
| 7 |
| Sec. 72. Professional engineers, architects, land |
| 8 |
| surveyors, and structural engineers; exemption from civil |
| 9 |
| liability for professional services in response to disasters or |
| 10 |
| catastrophic events. Any professional engineer, architect, |
| 11 |
| land surveyor, or structural engineer who in good faith, |
| 12 |
| without fee, provides professional services in response to a |
| 13 |
| disaster or other catastrophic event shall not be liable for |
| 14 |
| civil damages as a result of his or her acts or omissions in |
| 15 |
| providing the professional services, except for willful and |
| 16 |
| wanton misconduct. This immunity applies to services that are |
| 17 |
| provided without fee during or within 60 days following the end |
| 18 |
| of a disaster or catastrophic event.".
