AMENDMENT TO HOUSE BILL 1370

    AMENDMENT NO. ______. Amend House Bill 1370 on page 2, line

25 by changing "50%
20%" to "20%"; and

on page 2, line 27 by changing "5%
2%" to "2%"; and

on page 2, line 30 by inserting after the period the following:

"Where a second or subsequent action to recover underpayments 
7
is brought against a contractor or subcontractor and the 
8
contractor or subcontractor is found liable for underpayments 
9
to any laborer, worker, or mechanic, the contractor or 
10
subcontractor shall also be liable to the Department of Labor 
11
for 50% of the underpayments payable as a result of the second 
12
or subsequent action, and shall be additionally liable for 5% 
13
of the amount of any such penalty to the State for 
14
underpayments for each month following the date of payment 
15
during which the underpayments remain unpaid."; and
 
16
on page 3, line 32 by changing "5" to "4".
