1     AN ACT concerning transportation
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Vehicle Code is amended by changing
5 Sections 11-1202, 18b-105, and 18b-107 and by adding Section
6 12-815.2 as follows:
 
7     (625 ILCS 5/11-1202)  (from Ch. 95 1/2, par. 11-1202)
8     Sec. 11-1202. Certain vehicles must stop at all railroad
9 grade crossings.
10     (a) The driver of any of the following vehicles shall,
11 before crossing a railroad track or tracks at grade, stop such
12 vehicle within 50 feet but not less than 15 feet from the
13 nearest rail and, while so stopped, shall listen and look for
14 the approach of a train and shall not proceed until such
15 movement can be made with safety:
16         1. Any second division vehicle carrying passengers for
17     hire;
18         2. Any bus that meets all of the special requirements
19     for school buses in Sections 12-801, 12-803, and 12-805 of
20     this Code. The driver of the bus, in addition to complying
21     with all other applicable requirements of this subsection
22     (a), must also turn off all noise producing accessories,
23     including heater blowers, defroster fans, auxiliary fans,
24     and radios, before crossing a railroad track or tracks;
25         3. Any other vehicle which is required by Federal or
26     State law to be placarded when carrying as a cargo or part
27     of a cargo hazardous material as defined in the "Illinois
28     Hazardous Materials Transportation Act".
29     After stopping as required in this Section, the driver
30 shall proceed only in a gear not requiring a change of gears
31 during the crossing, and the driver shall not shift gears while
32 crossing the track or tracks.

1     (b) This Section shall not apply:
2         1. At any railroad grade crossing where traffic is
3     controlled by a police officer or flagperson;
4         2. At any railroad grade crossing controlled by a
5     functioning traffic-control signal transmitting a green
6     indication which, under law, permits the vehicle to proceed
7     across the railroad tracks without slowing or stopping,
8     except that subsection (a) shall apply to any school bus;
9         3. At any streetcar grade crossing within a business or
10     residence district; or
11         4. At any abandoned, industrial or spur track railroad
12     grade crossing designated as exempt by the Illinois
13     Commerce Commission and marked with an official sign as
14     authorized in the State Manual on Uniform Traffic Control
15     Devices for Streets and Highways.

18     Sec. 12-815.2. Noise suppression switch. Any school bus
19 manufactured on or after January 1, 2006 must be equipped with
20 a noise suppression switch capable of turning off noise
21 producing accessories, including: heater blowers; defroster
22 fans; auxiliary fans; and radios.

24     Sec. 18b-105. Rules and Regulations.
25     (a) The Department is authorized to make and adopt
26 reasonable rules and regulations and orders consistent with law
27 necessary to carry out the provisions of this Chapter.
28     (b) The following parts of Title 49 of the Code of Federal
29 Regulations, as now in effect, are hereby adopted by reference
30 as though they were set out in full:
31     Part 40 - Procedures For Transportation Workplace Drug and
32 Alcohol Testing Programs;
33     Part 380 - Special Training Requirements;
34     Part 382 - Controlled Substances and Alcohol Use and

1 Testing;
2     Part 383 - Commercial Driver's License Standards,
3 Requirements, and Penalties;
4     Part 385 - Safety Fitness Procedures;

6 Maximum Monetary Penalties;
7     Part 387 - Minimum Levels of Financial Responsibility for
8 Motor Carriers;
9     Part 390 - Federal Motor Carrier Safety Regulations:
10 General;
11     Part 391 - Qualifications of Drivers;
12     Part 392 - Driving of Motor Vehicles;
13     Part 393 - Parts and Accessories Necessary for Safe
14 Operation;
15     Part 395 - Hours of Service of Drivers, except as provided
16 in Section 18b-106.1; and
17     Part 396 - Inspection, Repair and Maintenance; and
18     Part 397 - Transportation of hazardous materials; Driving
19 and Parking Rules.
20     (b-5) Individuals who meet the requirements set forth in
21 the definition of "medical examiner" in Section 390.5 of Part
22 390 of Title 49 of the Code of Federal Regulations may act as
23 medical examiners in accordance with Part 391 of Title 49 of
24 the Code of Federal Regulations.
25     (c) The following parts and Sections of the Federal Motor
26 Carrier Safety Regulations shall not apply to those intrastate
27 carriers, drivers or vehicles subject to subsection (b).
28         (1) Section 393.93 of Part 393 for those vehicles
29     manufactured before June 30, 1972.
30         (2) Section 393.86 of Part 393 for those vehicles which
31     are registered as farm trucks under subsection (c) of
32     Section 3-815 of this Code.
33         (3) (Blank).
34         (4) (Blank).
35         (5) Paragraph (b)(1) of Section 391.11 of Part 391.
36         (6) All of Part 395 for all agricultural movements as

1     defined in Chapter 1, between the period of February 1
2     through November 30 each year, and all farm to market
3     agricultural transportation as defined in Chapter 1 and for
4     grain hauling operations within a radius of 200 air miles
5     of the normal work reporting location.
6         (7) Paragraphs (b)(3) (insulin dependent diabetic) and
7     (b)(10) (minimum visual acuity) of Section 391.41 of part
8     391, but only for any driver who immediately prior to July
9     29, 1986 was eligible and licensed to operate a motor
10     vehicle subject to this Section and was engaged in
11     operating such vehicles, and who was disqualified on July
12     29, 1986 by the adoption of Part 391 by reason of the
13     application of paragraphs (b)(3) and (b)(10) of Section
14     391.41 with respect to a physical condition existing at
15     that time unless such driver has a record of accidents
16     which would indicate a lack of ability to operate a motor
17     vehicle in a safe manner.
18     (d) Intrastate carriers subject to the recording
19 provisions of Section 395.8 of Part 395 of the Federal Motor
20 Carrier Safety Regulations shall be exempt as established under
21 paragraph (1) of Section 395.8; provided, however, for the
22 purpose of this Code, drivers shall operate within a 150
23 air-mile radius of the normal work reporting location to
24 qualify for exempt status.
25     (e) Regulations adopted by the Department subsequent to
26 those adopted under subsection (b) hereof shall be identical in
27 substance to the Federal Motor Carrier Safety Regulations of
28 the United States Department of Transportation and adopted in
29 accordance with the procedures for rulemaking in Section 5-35
30 of the Illinois Administrative Procedure Act.

35     Sec. 18b-107. Violations - Civil penalties. Except as

1 provided in Section 18b-108, any person who is determined by
2 the Department after reasonable notice and opportunity for a
3 fair and impartial hearing to have committed an act in
4 violation of this Chapter or any rule or regulation issued
5 under this Chapter is liable to the State for a civil penalty.
6 Such person is subject to a civil penalty as prescribed by
7 Appendix B to 49 CFR Part 386 -- Penalty Schedule; Violations
8 and Maximum Monetary Penalties of not more than $5,000 for such
9 violation, except that a person committing a railroad-highway
10 grade crossing violation is subject to a civil penalty of not
11 more than $10,000, and, if any such violation is a continuing
12 one, each day of violation constitutes a separate offense. The
13 amount of any such penalty shall be assessed by the Department
14 by a written notice. In determining the amount of such penalty,
15 the Department shall take into account the nature,
16 circumstances, extent and gravity of the violation and, with
17 respect to a person found to have committed such violation, the
18 degree of culpability, history or prior offenses, ability to
19 pay, effect on ability to continue to do business and such
20 other matters as justice may require.
21     Such civil penalty is recoverable in an action brought by
22 the State's Attorney or the Attorney General on behalf of the
23 State in the circuit court or, prior to referral to the State's
24 Attorney or the Attorney General, such civil penalty may be
25 compromised by the Department. The amount of such penalty when
26 finally determined (or agreed upon in compromise), may be
27 deducted from any sums owed by the State to the person charged.
28 All civil penalties collected under this subsection shall be
29 deposited in the Road Fund.

31     Section 99. Effective date. This Act takes effect upon
32 becoming law.
