Amends the School Code. Provides that each school board must adopt, no later than the 2006-2007 school year, nutritional goals and policies regarding the use of vending machines in schools. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.

| AN ACT concerning education.
|

| Be it enacted by the People of the State of Illinois,
|

| represented in the General Assembly:
|

| Section 5. The School Code is amended by adding Sections |
5 |
| 10-20.40 and 34-18.32 as follows: |

| (105 ILCS 5/10-20.40 new) |

| Sec. 10-20.40. Vending machines. Each school board must |
8 |
| adopt, no later than the 2006-2007 school year, nutritional |
9 |
| goals and policies regarding the use of vending machines in |
10 |
| schools, including without limitation getting rid of all foods |
11 |
| and soft drinks that have little or no nutritional value in |
12 |
| these vending machines. |

| Sec. 34-18.32. Vending machines. The board must adopt, no |
15 |
| later than the 2006-2007 school year, nutritional goals and |
16 |
| policies regarding the use of vending machines in schools, |

19 |
| vending machines.

| Section 90. The State Mandates Act is amended by adding |

| Section 8.29 as
follows:

| (30 ILCS 805/8.29 new)

| Sec. 8.29. Exempt mandate. Notwithstanding Sections 6 and 8 |
24 |
| of this
Act, no reimbursement by the State is required for the |
25 |
| implementation of
any mandate created by this amendatory Act of |
26 |
| the 94th General Assembly.

27 |
| Section 99. Effective date. This Act takes effect upon |
28 |
| becoming law.
