| AMENDMENT TO HOUSE BILL 2006

| AMENDMENT NO. ______. Amend House Bill 2006 by replacing |

| everything after the enacting clause with the following:
|

| "Section 5. The School Code is amended by changing Section |
| 5 |
| 27-13.2 as follows:
|
| 6 |
| (105 ILCS 5/27-13.2) (from Ch. 122, par. 27-13.2)
|
| 7 |
| Sec. 27-13.2. Required instruction; abduction; drug abuse; |
| 8 |
| sexual abuse.
|
| 9 |
| (a) In every public school there
shall be instruction, |
| 10 |
| study and discussion of effective methods by which
pupils may |
| 11 |
| recognize the danger of and avoid abduction, and in every
|
| 12 |
| public school maintaining any of grades kindergarten through 8 |
| 13 |
| there shall
be, for such grades, instruction, study, and |
| 14 |
| discussion of effective
methods for the prevention and |
| 15 |
| avoidance of drug and substance abuse.
School boards may
|
| 16 |
| include such required instruction, study and discussion in the |
| 17 |
| courses of
study regularly taught in the public schools of |
| 18 |
| their respective districts;
provided, however, that such |
| 19 |
| instruction shall be given each year to all
pupils in grades |
| 20 |
| kindergarten through 8. |
| 21 |
| Each year public schools must provide age-appropriate |
| 22 |
| instruction to all pupils in grades kindergarten through 12 |
| 23 |
| concerning the dangers of methamphetamine use, abuse, and |
| 24 |
| manufacturing, which instruction may be included in the courses |

| of study regularly taught in the public school.
|
| 2 |
| The State Superintendent of
Education may prepare and make |
| 3 |
| available to all public and non-public
schools instructional |
| 4 |
| materials which may be used by such schools
as guidelines for |
| 5 |
| development of a program of instruction
under this Section; |
| 6 |
| provided, however, that each school board shall
itself |
| 7 |
| determine the minimum amount of instruction time which shall |
| 8 |
| qualify
as a program of instruction
which will
satisfy the |
| 9 |
| requirements of this Section.
|
| 10 |
| (b) The State Superintendent of Education, in cooperation |
| 11 |
| with the
Department of Children and Family Services, shall |
| 12 |
| prepare and disseminate
to all public schools and non-public |
| 13 |
| schools, information on instructional
materials and programs |
| 14 |
| about child sexual abuse which may be used by such
schools for |
| 15 |
| their own or community programs. Such information may also be
|
| 16 |
| disseminated by such schools to parents.
|
| 17 |
| Notwithstanding the foregoing provisions of this Section, |
| 18 |
| no pupil in
any of grades kindergarten through 8 shall be |
| 19 |
| required to take or
participate in any class or course |
| 20 |
| providing instruction in recognizing and
avoiding sexual abuse |
| 21 |
| if the parent or guardian of the pupil submits
written |
| 22 |
| objection thereto; and refusal to take or participate in such |
| 23 |
| class
or course after such written objection is made shall not |
| 24 |
| be reason for
failing, suspending or expelling such pupil. Each |
| 25 |
| school board intending
to offer any such class or course to |
| 26 |
| pupils in any of grades kindergarten
through 8 shall give not |
| 27 |
| less than 5 days written notice to the parents or
guardians of |
| 28 |
| such pupils before commencing the class or course.

| Section 99. Effective date. This Act takes effect July 1, |
| 31 |
| 2006.".
