AMENDMENT TO HOUSE BILL 2330

    AMENDMENT NO. ______. Amend House Bill 2330, AS AMENDED, by 
3
replacing everything after the enacting clause with the 
4
following:

    "Section 5. The Illinois Insurance Code is amended  by 
6
adding Section 155.42 and by changing Section 424 as follows:

    (215 ILCS 5/155.42  new)
8
    Sec. 155.42. Auto collision repair facilities. In the 
9
settlement of motor vehicle property damage claims under a 
10
policy of insurance, the insurer shall do the following:
11
        (1) The insurer or the insurer's representative shall 
12
    notify the insured or claimant that the insured or claimant 
13
    may choose a repair shop of his or her choice.
14
        (2) If an insured or claimant uses an insurer's 
15
    preferred or wholly owned repair shop where an agreement 
16
    between the insurer and the repair shop exists, the insurer 
17
    shall notify the insured or claimant of the existence of 
18
    the agreement.".
