Amends the Illinois Clean Indoor Air Act. Provides that no person shall smoke in an area immediately outside the vicinity of a hospital or nursing home if that area of the hospital or nursing home has been established as a non-smoking area by the State or unit of local government, or by a proprietor and his or her agents in control of the hospital or nursing home.

| AN ACT concerning health.
|

| Be it enacted by the People of the State of Illinois,
|

| represented in the General Assembly:
|

| Section 5. The Illinois Clean Indoor Air Act is amended by |
| 5 |
| adding Section 4.5 as follows:
|

| (410 ILCS 80/4.5 new) |
| 7 |
| Sec. 4.5. Non-smoking area; hospitals and nursing homes. No |
| 8 |
| person shall smoke in an area immediately outside the vicinity |
| 9 |
| of a hospital or nursing home if that area of the hospital or |
| 10 |
| nursing home has been established as a non-smoking area by the |
| 11 |
| State or unit of local government, or by a proprietor and his |
| 12 |
| or her agents in control of the hospital or nursing home. For |
| 13 |
| purposes of this Section, "vicinity" means the surrounding area |
| 14 |
| of a place up to 30 feet away from the entrance.
