Amends the Hospital Licensing Act. Requires a hospital's discharge planner to provide the patient with information to enable the patient to contact the Department on Aging's case coordination unit. Requires that hospital procedures in connection with giving a discharge notice include prohibitions against discharges or referrals to unlicensed, uncertified, or unregistered facilities or service providers that are required to be licensed, certified, or registered. Effective immediately.

| AN ACT concerning regulation.

| Be it enacted by the People of the State of Illinois,
|
3 |
| represented in the General Assembly:
|

| Section 5. The Hospital Licensing Act is amended by |
5 |
| changing Section 6.09 as follows:
|

| Sec. 6.09. (a) In order to facilitate the orderly |
8 |
| transition of aged
and disabled patients from hospitals to |
9 |
| post-hospital care, whenever a
patient who qualifies for the
|
10 |
| federal Medicare program is hospitalized, the patient shall be |
11 |
| notified
of discharge at least
24 hours prior to discharge from
|
12 |
| the hospital. Pending approval from the patient, the discharge |
13 |
| planner must inform his or her designated case coordination |
14 |
| unit, as defined in 89 Ill. Adm. Code 240.260, of the pending |
15 |
| discharge and must provide the patient with the case |
16 |
| coordination unit's telephone number and other contact |
17 |
| information.
|

| (b) Every hospital shall develop procedures for a physician |
19 |
| with medical
staff privileges at the hospital or any |
20 |
| appropriate medical staff member to
provide the discharge |
21 |
| notice prescribed in subsection (a) of this Section. The |
22 |
| procedures must include prohibitions against discharging or |
23 |
| referring a patient to an unlicensed, uncertified, or |
24 |
| unregistered facility or service provider that is required to |
25 |
| be licensed, certified, or registered.
The procedure may also |
26 |
| include a waiver for any case in which a discharge
notice is |
27 |
| not feasible due to a short length of stay in the hospital by |
28 |
| the patient,
or for any case in which the patient voluntarily |
29 |
| desires to leave the
hospital before the expiration of the
24 |
30 |
| hour period.

| (c) At least
24 hours prior to discharge from the hospital, |

| the
patient shall receive written information on the patient's |
