SYNOPSIS AS INTRODUCED:
 
New Act
30 ILCS 105/5.640 new

    Creates the Good Samaritan Computer Program Act and amends the State Finance Act. Directs the Department of Commerce and Economic Opportunity to solicit voluntary contributions for the purpose of assisting low-income individuals and families in purchasing computers. Creates the Good Samaritan Computer Program Trust Fund, and provides that contributions under the Good Samaritan Computer Program Act shall be deposited into the fund. Provides that subject to appropriations, DCEO may use moneys in the fund to assist low-income individuals and families to purchase computers. Requires DCEO to make an annual report on the use and effectiveness of the fund. Effective January 1, 2006.

1     AN ACT concerning public aid.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 1. Short title. This Act may be cited as the Good
5 Samaritan Computer Program Act.
 
6     Section 5. Definition. In this Act, "Department" means the
7 Department of Commerce and Economic Opportunity.
 
8     Section 10. Good Samaritan Computer Program Trust Fund. The
9 Good Samaritan Computer Program Trust Fund is created as a
10 special fund in the State treasury. The Department shall
11 administer the Fund. The Department shall deposit moneys
12 received from the following sources into the Fund:
13         (1) Voluntary donations from individuals, foundations,
14     corporations, and other sources.
15         (2) Proceeds from fundraising events held for the
16     purpose of generating moneys for the Fund.
 
17     Section 15. Solicitation of contributions to Fund. The
18 Department shall take appropriate measures to solicit
19 voluntary contributions to the Fund from individuals,
20 foundations, corporations, and other sources.
 
21     Section 20. Administration of Fund. The Department shall
22 administer the Good Samaritan Computer Program Trust Fund.
23 Donations received for the Fund shall be made available for the
24 purpose of assisting low-income individuals and families, as
25 defined by the Department in rules, in purchasing computers,
26 except that the Department may use up to 10% of the moneys
27 donated for the Fund for the Department's expenses incurred in
28 administering the Fund.

1     Section 25. Distribution of moneys from Fund. Subject to
2 appropriations, the Department may spend moneys from the Good
3 Samaritan Computer Program Trust Fund for the purpose of
4 providing assistance authorized under Section 20. The
5 Department, by rule, shall establish priorities for the
6 distribution of moneys from the Fund to low-income individuals
7 and families to assist them in purchasing computers. The
8 Department shall ensure that moneys donated for the Fund (other
9 than moneys used for administrative expenses as authorized in
10 Section 20) are distributed to low-income individuals and
11 families who reside in the county from which those moneys were
12 received.
 
13     Section 30. Annual report. On or before May 31 of each
14 year, beginning in 2006, the Department shall provide an annual
15 report to the General Assembly on the use and effectiveness of
16 the Good Samaritan Computer Program Trust Fund. The report
17 shall include the amount of money deposited into the Fund, the
18 amount of money allocated from the Fund for the direct benefit
19 of low-income individuals and families, the number of
20 low-income households served by the Fund, by county, and
21 recommendations for improving the operation and effectiveness
22 of the Fund.
 
23     Section 90. The State Finance Act is amended by adding
24 Section 5.640 as follows:

27     Section 99. Effective date. This Act takes effect January
28 1, 2006.
